Fiscal Impact/Change to Net County Cost: No change.  The Agreement is funded by Federal/State Social Services allocation (85%) with required County match (15%) met primarily with realignment resources.  Funds for anticipated annual expenditures are budgeted for FY 2011-12 and will be included in the County Budget Request for FY 2012-13.
 
Compensation: Payments to contractor are made within forty-five (45) days following the County's receipt and approval of itemized invoices identifying services rendered. Compensation is based upon specified billing rates for actual services performed and documented per contract requirements.  Rates are tied to current Drug Medi-Cal reimbursement rates. Services and rates are detailed on pages 5 through 7 of Amendment I.
 
Termination: Agreement includes the County's standard Fiscal Considerations termination language as well as a provision for the County to terminate the Agreement without cause in seven (7) calendar days upon written notice.  
 
Background:
The provision of therapeutic counseling and substance abuse testing services continues to prove to be a successful tool for promoting reunification of families served by the Health and Human Services Agency (HHSA), Social Services Division (SSD), Child Protective Services Program.  Contracting out to local vendors continues to be the most efficient and cost effective method of delivering these services to eligible HHSA/SSD clients.  Services are accessed on an "as requested" basis and are provided in accordance with case plans authorized by the El Dorado County Superior Court system. HHSA/SSD maintains agreements with multiple local and state vendors for the provision of therapeutic counseling and substance abuse testing services to ensure that clients can be referred by their caseworkers on an "as requested" basis to receive necessary services from the most appropriate and conveniently located vendor.  Choice of vendor is based on the specific needs of each individual HHSA/SSD client.  
 
Reason for Recommendation:
Amendment I to Agreement for Services 317-S1010 with EDCA Lifeskills amends Article II - Term, by extending the length of the Agreement from a two-year term to a three-year term of April 26, 2010 to April 25, 2013, and Article III - Compensation for Services, by increasing  the maximum not-to-exceed amount of the Agreement from $57,470 to $100,000 for the stated term.  Amendment I also amends Article I - Scope of Services, Article VII - Nondiscrimination and Article XIX - Notice to Parties and  adds Article XXXIII - Debarment and Suspension Certification, Article XXXIV - Accounting Systems and Financial Records and Article XXXV - Annual Audit, and amend other Articles of the contract to conform to current County contract standards.
 
Purchasing Agent Review:  The County Purchasing Agent has reviewed the Agency's request to enter into this Agreement and concurs that it is in compliance with Board of Supervisors Policy C-17.
 
Action to be taken following Board approval:
1. Chair to sign two (2) originals of Amendment I to Agreement 317-S1010
2. Board Clerk to return one (1) signed original Agreement to HHSA/SSD at 3057 Briw Road.
3.  HHSA/SSD to distribute as appropriate.
