Title: Department of Transportation recommending the Board: 1) Authorize the Chair to sign the Notice of Acceptance with A. Reason for Recommendation:
The Contract Overlay - North Shingle Road (4 miles) Project (Project) in the Rescue area of the County of El Dorado was awarded by the Board to A. Teichert & Son, Inc. dba Teichert Construction (Contractor) on August 2, 2011.  Construction started on September 12, 2011.  Construction was completed on November 13, 2011.  Board execution and subsequent recordation of the Notice of Acceptance will allow the Department of Transportation (Department) to issue the proposed final estimate to the Contractor, which begins the Project closeout phase.  Recordation of the Notice of Acceptance will also start legal time frames for guarantees, a lien period, return of retention monies and the one-year time frame for releasing the payment and performance bonds to the surety.
 
The budget for direct construction costs for this Project was $680,000.  The original low bid price of this Project was $906,948.95.  Additional funding to compensate for the higher than expected bid price was obtained from State Proposition 1B and California Integrated Waste Management Board 2009/2010 Targeted Rubberized Asphalt Concrete Incentive Program Grant Funds.  The total estimated direct construction cost of this Project is as follows:
Estimated Construction Contract Item Cost            $856,380.00
Estimated Contract Change Orders                  $  44,402.00
Estimated Final Cost of Construction Contract      $900,782.00
 
The final costs listed above are estimates.  The Department will be closing out the Project with the Contractor and finalizing costs over the coming weeks.  Any significant deviations from the estimates above that exceed the Department's allocated authority will be brought back for Board review and approval in a subsequent agenda item.
 
Major contract change orders on this Project dealt with the following:
1.  Changing pavement markings from paint to sprayed thermoplastic.
2.  Changing materials and methods for hot mix asphalt placed at driveways and intersecting roadways.
 
Action to be taken following Board approval:
1. The Chair will sign the Notice of Acceptance.
2. The Clerk of the Board will send the Notice of Acceptance to the Recorder-Clerk's Office for recordation within ten (10) days of the Chair's signature and then forward a copy of the recorded Notice of Acceptance to the Department.
3. The Clerk of the Board will release the payment and performance bonds to the surety upon notification from the Department.
