Fiscal Impact/Change to Net County Cost:  No change.  The Agreement is funded by Federal/State Social Services allocation (85%) with required County match (15%) met primarily with realignment resources.  Funds for anticipated annual expenditures are budgeted for FY 2011-12 and will be included in future County Budget Requests.
 
Compensation:  Payments to contractor are made within thirty (30) days following the County's receipt and approval of itemized invoices identifying services rendered. Compensation is based upon specified billing rates for actual services performed and documented per contract requirements.  
 
Termination:  Agreement includes termination language that allows the County to terminate the Agreement without cause in sixty (60) calendar days upon written notice.  
 
Background:  On April 27, 2010,  the Board approved non-standard, perpetual Agreement 316-S1010 with Perinatal and Pediatric Specialists Medical Group, Inc. dba Children's Specialist Medical Group of Sacramento, Inc. (CSMGS) and Sutter Medical Center (Hospital), retroactive to April 25, 2010, for the provision of forensic evidentiary exam services on an "as requested" basis in cases where the County of El Dorado Health and Human Services Agency (HHSA) determines that a client's injuries warrant forensic examination by trained personnel to facilitate and enhance services provided to the client and when such an examination has not been scheduled by law enforcement.  While this service is used infrequently, it is necessary to have a contract in place in the event that a client needs forensic examination services in an emergency and/or within an immediate timeframe.
 
Reason for Recommendation:  Amendment I to Agreement 316-S1010 is necessary to assign the Agreement from CSMGS to Sutter Medical Foundation (Foundation) in order to continue a relationship with the Physician, Dr. Rosas, who provides the forensic evidentiary exams.  The original Agreement was developed and provided by CSMGS and Hospital to allow evidentiary exams to be conducted by Physician, Angela Rosas, M.D. at either CSMGS' Bridging Evidence Assessment and Resources (BEAR) Care Center or at the Sutter Memorial Center's hospital facility.  Dr. Rosas was the Director of the BEAR center at CSMGS and is the Medical Director for the Sutter Child Abuse Prevention Service. The BEAR Care Center is no longer affiliated with CSMGS but is now affiliated with Sutter Medical Foundation. "As requested" evidentiary services will now be provided by Dr. Rosas at either Foundation or Hospital. This Amendment I to the non-standard, perpetual Agreement is retroactive to January 1, 2012, with a total not-to-exceed compensation amount of $30,000 per annum.   The Amendment is retroactive due to late notice of the change in affiliation provided by the vendor.
 
Purchasing Agent Review:  The County Purchasing Agent has reviewed the Agency's request to enter into this assignment of Agreement 316-S1010 from CSMGS to Sutter Medical Foundation and concurs that it is in compliance with Board of Supervisors Policy C-17.
 
Action to be taken following Board approval:
1. Chair to sign four (4) originals of Amendment I to Agreement 316-S1010
2. Board Clerk to return three (3) signed originals to HHSA/SSD at 3057 Briw Road.
3.  HHSA/SSD to distribute as appropriate.
