Fiscal Impact/Change to Net County Cost:   None.  These debts are uncollectable because the debtor is deceased.  These debts have not been factored into the County budget.
 
Reason for Recommendation:  The Courts and Revenue Recovery have developed procedures for discharging debts based on guidelines provided by the Administrative Office of the Courts (AOC).  The procedures require approval by the Court Executive Committee and approval by the Board of Supervisors to discharge the uncollectable debts.  The Collection committee, comprised of the Court, Revenue Recovery and Probation recommend the discharge and dismissal of the debts included on the Discharge of Accountability Report.  This recommendation has been approved by the Court Executive Committee.  Board of Supervisors approval is also required.
 
This item is being brought before the Board of Supervisors pursuant to Government Code sections 25257-25259, . . . "the likelihood of collection does not warrant the expense involved" . . .  All of the debtors are deceased resulting in the remaining debts being uncollectable.
 
Action to be taken following Board Approval: The Board of Supervisors approve the discharge and dismissal of the debts on the Discharge of Accountability Report.
