Background:
On July 22, 2008 the board approved the Implementation Agreement Regarding Processing of Pre-paid El Dorado Hills TIM Fees (West Valley, LLC).  The implementation agreement generally describes the process of applying pre-paid TIM fee credits to building permits in the Blackstone project.
 
Reason for Recommendation:
On February 14, 2012 the Board approved Resolution 021-2012 amending the 2004 General Plan Traffic Impact Mitigation Fee Program and Revised Traffic Impact Mitigation Fee Rates.  This action modifies the 2004 General Plan TIM Fee Program, as well as adds an Age-Restricted Single Family and Multi Family Housing category to the program.   
 
The proposed Amendment for the implementation agreement clarifies the accounting and processing of prepaid traffic impact fees if the modifications to the 2004 General Plan TIM Fee Program were to have calculated fees that are less than the prepaid amount.  Additionally, the amendment provides for Developer's waiver of objection and consent to a lesser amount of fees returned to Developer.
 
Action to be taken following Board approval:
Board Chair to execute the two originals of the First Amendment to Implementation Agreement Regarding Processing of Pre-paid El Dorado Hills TIM Fees (West Valley, LLC).
