Fiscal Impact/Change to Net County Cost:   There is no Net County Cost associated with this Agreement.  All expenditures will be funded through Assembly Bill (AB) 109 "2011 Public Safety Realignment"
 
Background:  April 4, 2011, Governor Brown signed into law Assembly Bill (AB) 109, commonly referred to as "2011 Public Safety Realignment", as later amended by AB 117. The 2011 Public Safety Realignment (hereinafter referred to as AB 109) was intended to address the State's need to reduce prison overcrowding, have a positive impact on the State's budget crisis, and transfer (or realign) the responsibility for certain offenders to the local level.
 
AB 109 requires the local Community Corrections Partnership (CCP) be created with members representing the Presiding Judge of the Superior Court; County Supervisor or Chief Administrative Officer; District Attorney; Public Defender; Sheriff; Chief of Police; Department of Social Services; Department of Mental Health; Department of Employment; the County Alcohol and Substance Abuse programs; Office of Education; and stakeholders from the community. The CCP developed the Public Safety Realignment Plan for Fiscal Year 2011/2012, which was presented to and approved by the Board on September 26, 2012 via board item 11-0841.
 
One aspect of the Public Safety Realignment Plan included a provision for alcohol and drug treatment services for those individuals who are eligible under the following criteria:
·      Certain non-violent, non-serious, non-sex offenders who are no longer eligible for commitment to California Department of Corrections, but rather are only eligible for commitment to county jail for the term prescribed by law;
·      Post Release Community Supervision offenders who are now subject to supervision by the Probation Department, rather than State parole; and
·      Mandatory Community Supervision offenders where the Court may suspend a portion of the county jail commitment and require the offender serve the suspended portion on mandatory supervision by the Probation Department.
 
Agreement 484-S1210 with Progress House, Inc. provides for both residential and outpatient treatment services for those individuals identified to be eligible for said services under AB 109 and who have been referred for treatment via a Treatment Authorization form by the Alcohol and Drug Program "AB 109 Treatment Coordinator."
 
Compensation for Services:  Payments are made to the contractor based on monthly invoicing at specified rates for actual services performed and documented per contract requirements.  
 
Retroactive Term:  The term of this Agreement begins March 1, 2012 to ensure payment of invoices for treatment under AB 109. In December 2011 the Program Manager met with Public Health staff indicating that there may be a need to develop an agreement for services under AB 109; a written request for said Agreement was received January 18, 2012. The draft Agreement was completed March 2, 2012, submitted for the departmental review process, and forwarded to County Counsel and Risk Management for review on March 8, 2012. The Agreement was approved by Counsel and Risk Management and returned to Public Health on March 15, 2012. The Agreement was forwarded to Probation for signature and returned on March 26, 2012; and was next forwarded to vendor for signature and returned on March 28, 2012.  The item has been submitted for the next available Board Agenda on April 10, 2012.
 
Contract Termination:  The Agreement includes the County's standard Fiscal Considerations termination language, as well as a provision for the County to terminate the Agreement without cause with seven (7) calendar days written notice.
 
Reason for Recommendation:   Approval of this Agreement will allow the Alcohol and Drug Treatment Program to provide services to those individuals identified as eligible for treatment under AB 109.
 
Action to be taken following Board approval:
1.      Chair to sign four (4) original Agreements 484-S1210.
2.  Board Clerk's Office to return three (3) signed original Agreements to Public Health.
3.      Public Health to distribute documents as appropriate.
