Fiscal Impact/Change to Net County Cost:
The total construction cost associated with the proposed PG&E relocation work is estimated at $20,000.  PG&E shall be responsible for fifty percent (50%) of the construction costs associated with the underground utility relocation work in the amount of $12,000 (AGMT 12-53437).  The County is responsible for fifty percent (50%) of the construction costs associated with the underground utility relocation work in the amount of $12,000 and for one hundred percent (100%) of the construction costs associated with the overhead utility relocation work in the amount of $8,000 (AGMT 12-53438) and will be funded by the State Corridor Mobility Investment Account (CMIA) funds and Local Transportation funds.  
 
Background:
On January 20, 2012, the El Dorado County Transportation Commission (EDCTC) proposed to the California Transportation Commission (CTC) and Caltrans that the U.S. 50 El Dorado Hills Interchange - Phase 2B.1 (AKA HOV Phase 0) Project (Project) construction be allocated $15,500,000 in CMIA.
 
On January 31, 2012, the Board authorized the Department of Transportation (Department) to advance the Project and to issue a Task Order with Quincy Engineering to prepare PS&E and to provide Right of Way and Utility Certification.
 
On February 28, 2012, the Board adopted Addendum No. 3 to the (Environmental Impact Report) EIR to split Phase 2B, and create a Phase 2B.1 and 2B.2.  Phase 2B.1 includes improvements to the westbound on and offramps.
 
On March 6, 2012, the Board authorized the ordering of title reports, certified appraisals, and the commencement of the acquisition process.
 
Subsequent to these actions, the Department is working with Quincy Engineering to finalize PS&E and Right of Way.  During the design process it was determined that PG&E facilities are in conflict with the future westbound on-ramp.  These facilities must be relocated for the Project improvements.
 
Reason for Recommendation:
The execution of these proposed Agreements are a prerequisite for the CTC's allocation of the CMIA funds, currently scheduled for April 26th/27th, and a requirement for the Project to move forward to construction.  Execution of these Agreements by the County and PG&E will allow scheduling the Project on the CTC agenda for allocation.  Delays in allocation of the CMIA funds could potentially jeopardize the availability for this Project.
 
Action to be taken following Board approval:
1. The Board Chair will sign two originals of the Construction Responsibility and Reimbursement Agreement No. AGMT 12-53437 between the County of El Dorado and PG&E, and two originals of the Construction Responsibility and Reimbursement Agreement No. AGMT 12-5348 between the County of El Dorado and PG&E subject to review and approval by County Counsel and the Department of minor modifications.
2. The Board Clerk will forward one fully executed original of each Agreement to the Department for further processing.
