*The Department of Transportation (Department) included $40,000 for the Agreement in its proposed Fiscal Year (FY) 2012/2013 budget.  The remaining $460,000 will be budgeted in subsequent FY budgets.
      
Fiscal Impact/Change to Net County Cost:
The Department included $40,000 for the Agreement in its proposed FY 2012/2013 budget submittal and anticipates budgeting the remaining $460,000 in subsequent FY budgets for the Agreement.  Funding for the Agreement will be provided by Highway Bridge Program, Regional Surface Transportation Program and various other Capital Improvement Program (CIP) funding sources that fund the Department's CIP projects.
 
Background:
The Procurement and Contracts Division completed a Request for Qualifications (RFQ) process for the Department in February 2011.  A multi-jurisdictional panel evaluated and ranked each Statement of Qualifications and established, based on category of service, a short list of acceptable service vendors.  For Category 2B, Geotechnical, Kleinfelder West, Inc. was ranked first out of a field of 19 participants.  The Department is utilizing Method 2 - Rotation from this RFQ and is proposing to establish the subject Agreement to provide the geotechnical and geological engineering support services that will be required in support of the Department's CIP projects on a rotational basis.
 
Reason for Recommendation:
The Department recommends the Board make findings pursuant to Article II, Section 210 b (6) of the El Dorado County Charter that there are specialty skills required for the work performed under the Agreement that are not expressly identified in County classifications, and that the ongoing aggregate of work to be performed under the Agreement is not sufficient to warrant the addition of permanent staff.
 
The disciplines required for the services to be performed under the Agreement include geotechnical, geological, environmental, and construction engineering skills, as well as quality assurance testing of materials and concrete, structural section core sampling and design recommendations, Resistance "R" value analysis, foundation analysis, geophysical investigation methods such as ground penetrating radar, refraction seismic and resistivity geophysical exploration, reports and design recommendations, fugitive and asbestos dust monitoring/mitigation, groundwater investigations, slope stability analysis, subsurface exploration, test bore core sampling and logging, geologic field mapping and report preparation, and specialized inspections for welding, concrete, asphalt and soils.
 
Some of the work to be performed under the Agreement is bargaining unit work; however, there are specialty skills required for much of the work which are not expressly identified in County classifications.  The Department has some staff skilled in the basics of materials testing.  However, the majority of the services require skills that are not expressly identified in County job classifications.  The need for expertise in specialty services at both the design and construction phases of the projects, and the need for materials testing make it necessary to supplement available resources.  The Department's current laboratory staff does not have the equipment or the expertise necessary to perform all the tasks that are required to accomplish the testing necessary for the construction season workload.  In addition to providing expert and experienced staff, Kleinfelder West, Inc. will supply the appropriate specialized equipment necessary to perform the work.  The need for such skills is sporadic and temporary and not applicable for all CIP projects.
 
Board of Supervisors Policy C-17 requires Board of Supervisors approval for contracts exceeding three years; therefore, the Department is seeking Board approval since the term of the Agreement may exceed three years.
 
The Purchasing Agent reviewed and provided approval of the Department's request to process the Agreement for geotechnical and geological engineering support services and concurs that the Department's request is in compliance with Board of Supervisors Policy C-17.
 
The El Dorado County Employees Association, Local #1, has been informed of these proposed Agreements.
 
Action to be taken following Board approval:
1. The Acting Clerk of the Board will obtain the Chair's signature on the two originals of the subject Agreement.
2. The Acting Clerk of the Board will forward one original of the fully executed subject Agreement to the Department for further processing.
