Background
The Procurement and Contracts Division completed a Request for Qualifications (RFQ) process for the Department of Transportation (Department) in February 2011.  Vali Cooper & Associates, Inc. (VCA) was ranked third on the Construction Management and Other Construction Services RFQ shortlist.  With approval from the Procurement and Contracts Division, the Department's Construction Division conducted a Request for Proposals (RFP) process and sent RFPs to ten consultant firms for construction support services for the U.S. 50 HOV Lanes (Phase 2A) - Bass Lake Road to Cameron Park Drive Project (Project) on December 6, 2011.  The evaluation and selection process was conducted in December 2011.  Thor Larsen, Senior Civil Engineer, Aradhana Kochar, Acting Senior Civil Engineer, and Mike van Doorninck, Principal Engineering Technician, conducted the interviews.  It was determined that VCA had the best qualified staff to assist the Department in successfully inspecting the Project.
 
On March 20, 2012, the Board authorized the Chair to sign Agreement for Services No. AGMT 11-53368 (Agreement) with VCA for construction support services for the Project.  
 
Reason for Recommendation
The Department recommends the Board make findings pursuant to Article II, Section 210 b (6) of the El Dorado County Charter that the ongoing aggregate of work to be performed under this Amendment is not sufficient to warrant the addition of permanent staff.
 
The purpose of the Amendment is to: add certified payroll requirements to ARTICLE III, Compensation for Services; add certified payroll submittal requirements to ARTICLE XIV, Prevailing Wage; add the State of California as an indemnified party to ARTICLE XVIII, Indemnity, as required by the County's Cooperative Agreement with the State of California Department of Transportation (Caltrans); and delete the reference to Task Order in ARTICLE, XLIV, Disputes.  There are no changes to the term or compensation amount of the Agreement.
 
The Purchasing Agent reviewed and provided approval of the Department's request to process this First Amendment with VCA and concurs that the Department's request is in compliance with Board of Supervisors Policy C-17.
 
The El Dorado County Employees Association, Local #1, has been informed of this proposed Amendment.
 
Action to be taken following Board approval:
1) The Acting Clerk of the Board will obtain the Chair's signature on the two originals of the Amendment.
2) The Acting Clerk of the Board will forward one original of the fully executed Amendment to the Department for further processing.
