Fiscal Impact/Change to Net County Cost
Acquisition costs are $800 with title and escrow fees estimated at $1,500 for a total estimated cost of $2,300.  Funding for the acquisition process will be provided by 2004 General Plan Traffic Impact Mitigation Fees and Highway Safety Improvement Program Grant Funds.
 
Background
The Department of Transportation (Department) is working to advance the Pleasant Valley Road at Oak Hill Road Intersection Improvements Project (Project), which includes widening of shoulders approaching the intersection; the addition of turn pockets or a two-way left turn lane; grading and paving; drainage improvements, and minor landscaping.
 
The Project is subject to the California Environmental Quality Act (CEQA) and the National Environmental Policy Act (NEPA).  On May 23, 2010 the Board certified the CEQA Mitigated Negative Declaration and approved the Project and authorized the Department to proceed with the acquisition process for the land rights necessary for the construction and completion of the Project.  The Department is authorized by the State of California Department of Transportation (Caltrans) to complete Waiver Valuations up to $10,000 on projects.
 
Reason for Recommendation
Negotiations have concluded with the property owners, Daniel Robert Cargill and Laurie Ann Cargill, Trustees in Trust Under The Cargill Family Trust Dated August 19, 2003, and a settlement has been reached that is representative of the Waiver Valuation of the necessary land rights.  Project construction is scheduled to begin in late summer 2012.
 
Action(s) to be taken following Board approval
1. The Acting Clerk of the Board will obtain the Chair's signature on the Easement Acquisition Agreement for Public Purposes and the Certificate of Acceptance for the Grant of Slope and Drainage Easement.
2. The Acting Clerk of the Board will return all executed documents to the Department for final processing.
