Fiscal Impact/Change to Net County Cost
No change. There is no Net County Cost associated with this Agreement. Funds are budgeted in Fiscal Year 2012-13.
Compensation for Services
Payments will be made to Contractor based upon monthly invoicing at specified billing rates for actual services performed and documented per contract requirements.
Termination
Agreement includes the County's standard Fiscal Considerations termination language, as well as a provision for the County to terminate Agreement without cause in seven (7) calendar days upon written notice.
Retroactive Term
The Agreement's term is July 1, 2012 through June 30, 2013. The development and processing of the Agreement required verification of MHSA funding availability resulting in a delay to the execution of the Agreement.
Background
On September 28, 2010, the Board approved the Fiscal Year 2010-11 Mental Health Services Act ("MHSA") Community Services and Supports, Prevention and Early Intervention ("PEI"), and Workforce Education and Training Plan Updates (Agenda Number 5, File ID 10-0963). The PEI portion of the Board-approved MHSA Plan specifically calls for the Foothill Indian Education Alliance (serving as the fiscal agent) to initiate and provide Wennem Wadati-A Native Path to Healing ("Wennem Wadati") program services. On October 26, 2010 (Agenda Number 12, File ID 10-1106) the Board approved Agreement for Services 426-S1011 with Foothill Indian Education Alliance ("FIEA") for the provision of Wennem Wadati program services. Amendment I to Agreement for Services 426-S1011 was approved by the Board on January 24, 2012 (Agenda Number 18, File ID 12-0038), increased the compensation by $70,000, and extended the term of the Agreement from January 31, 2012 to June 30, 2012 .
Reason for Recommendation
The Wennem Wadati program is a highly effective and culturally-specific intervention strategy program designed to address gaps in service, health disparities, and the effects of traumatic stress in the local American Indian community. The program reduces barriers to mental health care access while decreasing the health disparities experienced by the American Indian population on the Western Slope. Due to the success of the Wennem Wadati program, the Health and Human Services Agency, Mental Health Division ("HHSA") is recommending its continuation for Fiscal Year 2012-13.
Agreement for Services 019-S1311 replaces prior Agreement 426-S1011 with the Foothill Indian Education Alliance, will be effective upon execution and covers the term of July 1, 2012 through June 30, 2013 with a maximum compensation of $105,760 for the continued provision of Wennem Wadati program services.
Purchasing Agent Recommendations
The Purchasing Agent has determined that it is appropriate to dispense with a competitive selection process in order to continue with the needed services and, in accordance with Board of Supervisors Policy C-17, Section 7.4.1, further concurs with HHSA's request to continue to contract with this independent contractor.
Action to Be Taken Following Board Approval
1) Chair to sign two (2) originals of Agreement 019-S1311.
2) Board Clerk's Office to return one (1) fully executed original Agreement to HHSA Contracts Unit at Briw Road.
3) HHSA to distribute as appropriate.
