Title: Health and Human Services Agency, Public Health Division, recommending the Board adopt Resolution 115-2012 authorizing the Chair to sign the Federal Ryan White Comprehensive Acquired Immunodeficiency Syndrome Resources Emergency Act funding agreement with the County of Sacramento Department of Health and Human Services in the amount of $472,578 for the estimated term dates of July 1, 2012 through June 30, 2015. Background
Congress created the Ryan White Comprehensive Acquired Immunodeficiency Syndrome Resources Emergency ("CARE") Act in 1990 and reauthorized the Act in 2009.  The CARE Act is a series of grant programs that fund treatment services for people with Human Immunodeficiency Virus ("HIV") and/or Acquired Immunodeficiency Syndrome ("AIDS") who are either uninsured or underinsured.  Unlike Medicare or Medicaid, CARE Act funded programs ("Ryan White Program") are "payer of last resort" that fund treatment when no other resources are available
Sacramento County is the applicant/recipient for CARE Act funds for the eligible metropolitan area and serves as the fiscal agent distributing those funds to various counties, including the County of El Dorado.  
 
Funding Agreement 927-F0811 with Sacramento County for the provision of CARE Act funding expired June 30, 2012.  The pending funding Agreement will be retroactive to July 1, 2012.
Reason for Recommendation
Adoption of Resolution No. _______ by the County of El Dorado is required by the County of Sacramento prior to their completion of the pending Federal Ryan White CARE Act funding agreement with the County for the estimated term dates of July 1, 2012 through June 30, 2015 in the amount of $472,578.  
 
Upon receipt of the CARE Acting funding agreement from Sacramento County, Resolution No. _______ authorizes the Chair of the Board of Supervisors to execute, on behalf of the County, the proposed retroactive funding agreement after it is issued by the County of Sacramento and any subsequent amendments, if any, pertaining to the funding agreement, contingent upon approval by County Counsel and Risk Management.
In addition, upon execution of the CARE Act funding agreement, the Health and Human Services Agency anticipates subcontracting with Sierra Foothills AIDS Foundation ("SFAF"), a community-based agency specializing in services to individuals and families afflicted with HIV/AIDS, to provide services on behalf of El Dorado County for its Ryan White Program.  The subcontract with SFAF will be retroactive to July 1, 2012.
 
Action(s) to be taken following Board approval
1)      Board Clerk to provide Health and Human Services Agency ("HHSA") Contracts Unit Briw Road with:
a. Two (2) certified Resolutions, to distribute as appropriate; and
b. Two (2) certified Minute Orders, to distribute as appropriate.
2)      Upon receipt of the CARE Act funding agreement from Sacramento County, HHSA to:
a. Route said agreement through County Counsel and Risk Management for review and approval; and
b. Provide Board Clerk with County Counsel and Risk Management approved original copies for execution by the Chair of the Board of Supervisors.
3)      Board Clerk's Office to return signed original agreements to HHSA Contracts Unit at Briw Road.
4)      HHSA to submit signed original agreements to Sacramento County for final execution.
5)      Upon receipt of the fully executed original agreement from Sacramento County, HHSA to return one (1) fully executed original to the       Board Clerk's Office.
6)      HHSA to prepare the retroactive agreement with Sierra Foothills AIDS Foundation to provide services on behalf of the County for its       Ryan White Program.
