*The $205,256 to be secured through this Exchange Fund Transfer Agreement will be programmed in the FY 2013/2014 (FY 13/14) and FY 2014/2015 (FY 14/15) Operational Budgets as follows: $150,000 in FY 13/14 and $20,000 in FY 14/15 for Project 95186 and $35,256 in FY 14/15 for Project 95708.  Both Projects with associated funds are included within the approved 2012 Capital Improvement Program (CIP).
 
Fiscal Impact/Change to Net County Cost
There is no change to net County cost. Funds will be programmed in FY 13/14 and FY 14/15 budget accordingly.
 
Background
Section 182.6(g) of the Streets and Highways Code authorizes the Tahoe Regional Planning Agency (TRPA) to exchange the assigned Federal apportionments made available to TRPA under the Safe, Accountable, Flexible, Efficient, Transportation Equity Act - A Legacy for Users (SAFETEA-LU), Regional Surface Transportation Program (RSTP), for nonfederal State Highway Account funds.  Through Agreements [Agreement numbers: X11-6125(027) and X12-6125(028)} pursuant to Section 182.6 of the Streets and Highways Code, between Caltrans and TRPA, these funds have been exchanged for a like amount of State funds.  TRPA has accumulated these funds over prior period funding cycles and the activities proposed by the Department of Transportation (Department) meet their funding criteria.
 
In order for El Dorado County to receive these exchanged funds from TRPA, an Exchange Fund Transfer Agreement (EFTA) between TRPA and El Dorado County is needed to transfer the State funds.  The funds are proposed to be used within the Tahoe basin on the Lake Tahoe Boulevard Enhancement Project (CIP No. 95186) and Highway 89 Class 1 Trail Project (CIP No. 95708) which are included within the TRPA Environmental Improvement Program.
 
Reason for Recommendation
This recommended action will allow the Department to receive $150,000 of State revenue through the TRPA for the construction and related construction engineering work related to CIP No.95186, which will be programmed within the FY 13/14 Budget.  Furthermore, the Department will receive the remaining RSTP Agreement amount of $20,000 and $35,256 for CIP No. 95186 and CIP No. 95708 respectively in FY 14/15, which will be programmed accordingly within the FY 14/15 Budget.  
 
Action(s) to be taken following Board approval
1. The Acting Clerk of the Board will obtain the Chair's signature on two originals of the Exchange Fund Transfer Agreement with the TRPA.
2. The Acting Clerk of the Board will return two signed original Agreements to Department.
 
Action(s) to be taken by the Department following Board approval:
1. The Department will forward the two partially executed original Agreements to TRPA for signature and upon return of one fully executed Agreement from TRPA the Department will forward said Agreement to the Acting Clerk of the Board.
2. The Department will prepare an invoice to obtain the available funding.
