Background
Pursuant to Government Code Section 66908.3, the California Tahoe Conservancy (CTC) is authorized to lease acquired lands. When such lands are within El Dorado County (County) and are leased to private individuals or groups, the CTC must transfer twenty-five percent of the gross income of the leases to the County each year. Pursuant to the Budget Act of 2011, Chapter 33/11, the Legislature has appropriated $7,648.00 to the CTC for transfer to the County as private lease revenue for this fiscal year. At least fifty percent of this amount is to be used for soil erosion control projects in the Lake Tahoe region, as defined in Section 66905.5 of the Government Code.

Reason for Recommendation
The CTC Lease Agreement # CTA-12005 (Agreement) provides the twenty-five percent of the gross income from CTC leases to private individuals or groups on lands owned by the CTC in the County for transfer to the County . The Department will allocate the entire $7,648.00 to soil erosion control projects.

The Agreement also includes the requirement that the County sign the Contractor Certification regarding non-discrimination, drug-free workplace requirements, and other provisions for which certification is required when doing business with the State of California. The County's current practices are consistent with these requisites.

The term of this Agreement is retroactive from July 1, 2012 through June 30, 2013. The Department did not receive the subject Agreement until July 24, 2012 and is now seeking the Board's approval to...
