Fiscal Impact/Change to Net County Cost
There is no change to net County Costs associated with this agenda item within this 2012/2013 Fiscal Year.  The three project expenses associated with the grant funding from the CTC, once received, will be programmed within the 2013 Capital Improvement Program.  The twenty year maintenance obligation might impact the future County Road Fund with respect to maintaining the capital improvements funded by the CTC Grant Program.  There are current maintenance costs associated with maintaining the existing County Maintained Roadway aging infrastructure within the three CTC Grant projects.  Therefore, the CTC Grant funds will assist with the capital replacement costs, potentially reduce the routine maintenance efforts associated with the existing aging infrastructure, and will further assist the County in complying with the National Pollution Discharge Elimination System Permit requirements.  
 
Background
On July 18, 2006, County's Board Chair signed the site improvement grant funding Agreement from the CTC CTA-05023 for the Angora 3 Erosion Control Project (CIP Project Nos. 95160/95164).  The Department was able to utilize this grant funding to complete the Angora Fire Rehabilitation Project, Zone C, to construct water quality improvements, which were completed on November 4, 2007.  On June 17, 2008, the Board authorized a grant augmentation from the CTC to increase the grant amount for the construction of the remaining Angora 3 Erosion Control Project work.  The construction contract with associated construction management work was completed on October 31, 2008.  The Department completed the post-construction work as required by the grant in 2011.  Due to favorable construction bids in 2008 with minimal change orders and sufficient funds to complete the post-construction phase of the Angora 3 Erosion Control Project, the grant deliverables and requirements were completed with a remaining grant balance of $1,026,352.
 
The CTC CTA-05023 Grant expired on June 30, 2012 with the remaining balance within the Grant from the original bond source reverting back to the CTC.  This amount can now be requested by the CTC for re-appropriation in a future State budget year.  Since the grant expired on June 30, 2012, the grant funds would not be available for re-appropriation until the 2013/2014 fiscal year.  Therefore, the Department in coordination with the CTC staff is requesting to re-encumber this remaining amount of $1,026,352 and distribute the funds to three separate erosion control/ water quality projects.  These funds will be further defined in the Department's proposed 2013 Capital Improvement Program for the Tahoe Environmental Improvement Program (EIP).
 
Reason for Recommendation
The Department is requesting site improvement grant funding from the CTC for the Golden Bear Erosion Control, County Service Area #5 Erosion Control, and the Forest View Water Quality Projects in the Tahoe Basin.  In order for the CTC Governing Board to approve the Department's final site improvement grant applications, the Board must adopt a Resolution demonstrating its commitment to the projects and the objectives and assurances of the CTC and the CTC's Program.
 
Upon approval by the Board, the Department will incorporate the Resolution into the three final CTC grant applications for the three CIP/EIP projects.  If the CTC Governing Board approves the Department's site improvement grant requests, the County will need to enter into separate grant agreements with the CTC for each project.  Therefore, the Department will be seeking County Counsel review and approval with a recommendation to the Board for approval and execution of the final grant agreements as part of a subsequent agenda item.  
 
Action(s) to be taken following Board approval
1.      The Clerk of the Board will obtain the Chair's signature on the Resolution.
2.      The Clerk of the Board will forward the signed Resolution to the Department.
 
Action(s) to be taken by the Department following Board approval:
1.      The Department will incorporate the Resolution into the final grant applications to the CTC.
2.      Upon notification of award from the CTC, the Department will continue working with the CTC and County Counsel to finalize the grant agreements.
3.      The Department will bring the final CTC grant agreements to the Board for final approval and execution at a subsequent Board meeting.
