Fiscal Impact/Change to Net County Cost
The Department of Transportation (Department) budgeted $269,950 for this proposed Amendment in its 2012/2013 Fiscal Year budget.  Funding for the Amendment will be provided by the Missouri Flat Master Circulation and Funding Plan, 2004 General Plan Highway 50 Traffic Impact Mitigation fees, and 2004 General Plan Traffic Impact Mitigation fees.  There is no change to net County cost associated with this agenda item.
This Amendment will increase the Agreement by $269,950 for a total not-to-exceed amount of $4,775,950 and is apportioned approximately as follows: Bike Path design - $148,314; Phase 1C revisions to meet current standards and permit modification - $73,000; and construction services, Record Drawings and contingency - $48,636.
Background
On February 15, 2005 the Board approved Agreement for Services # AGMT 04-671 (Agreement) with Quincy Engineering, Incorporated (Quincy) to provide planning, design and project delivery services for the U.S. 50/Missouri Flat Road Interchange Improvements - Phase 1 Project (Project).  On June 27, 2006 the Board approved Amendment I to the Agreement and on May 4, 2010 the Board approved Amendment II to the Agreement.
Over the duration of the Agreement, Quincy has provided two sets of Plans, Specifications and Estimates (PS&E) resulting in the construction of Phase 1A and Phase 1B of the interchange.
In the course of delivering Phase 1B of the Project, substantial Federal American Recovery and Reinvestment Act (ARRA) stimulus funding became available sufficient to fund the construction of a bicycle and pedestrian path (Bike Path) along the length of the Project from Missouri Flat Road to Placerville Drive.  The design of the Project was modified to include this feature into the Phase 1B Project, which has been substantially constructed.
In May 2012, while reviewing the neighboring Western Placerville Interchange (WPI) Project, the State of California Department of Transportation (Caltrans) raised a concern regarding the configuration of the Bike Path relative to its impact on sight distance for eastbound U.S. Highway 50 traffic.  A series of meetings involving Department staff, El Dorado County Transportation Commission (EDCTC) staff, Caltrans representatives, Federal Highway Administration (FHWA) representatives, and Quincy staff were held to discuss the situation and address the concerns.  The culmination of this review was the determination that a modification to the facility was required to provide sufficient sight distance along U.S. Highway 50 and minimize elements of the Project which would require reconstruction during the future WPI.  This change to the Project will require substantial work, including the construction of a major retaining wall adjacent to the Bike Path to allow the Bike Path to be shifted away from highway traffic.  The cost to construct these improvements is currently under review; however, preliminary estimates anticipate this construction may cost approximately $3 million.  The construction of this work is targeted for 2014.
The Amendment will provide a lump sum compensation to Quincy for their services related to the design of the realigned Bike Path, retaining wall, geotechnical investigation, barriers, drainage and other related facilities, the Scope of which is included in the Amendment.  Department, Caltrans, EDCTC and FHWA staff are working to identify funding for the construction of these improvements.
Reason for Recommendation
Under the current Agreement, Quincy is tasked with providing PS&E for the implementation of Project environmental mitigation measures including landscaping, irrigation, oak tree planting, and riparian restoration.  This work is included in the Department's Capital Improvement Program as U.S. 50/Missouri Flat Road Interchange Improvements - Phase 1C Riparian Restoration (Phase 1C).  Caltrans made changes to its design and contracting standards subsequent to the preparation of portions of the Phase 1C PS&E.  The Amendment provides for additional compensation to address the changes in standards and modifications to the Project's mitigation as required by the Project's environmental permits.  Phase 1C work is anticipated to be constructed in 2013.
The Agreement also provides for design services during construction for the remaining phases, as well as the preparation of Record Drawings, documenting the Project's construction process.  The Amendment provides additional compensation for these activities as may be required, including a contingency element for unforeseen events.
Department, EDCTC, Caltrans, FHWA and Quincy staff have collaborated to provide for an improved Bike Path design which will meet the Caltrans highway design requirements and minimize relocation costs when the WPI is constructed.  These same agencies are currently searching to identify funding to construct these modifications.
Approval of the Amendment will provide for the design elements of the Project that staff believes are fair, reasonable and necessary to complete the Bike Path and related facilities.  The Amendment will also provide for efforts required to bring the Phase 1C Landscape and Riparian Restoration bid package to current standards consistent with revised Project permits and services needed for completion of the remaining phases.
The El Dorado County Employees Association, Local #1, has been informed of this proposed Amendment.
Action(s) to be taken following Board approval
1. The Clerk of the Board will obtain the Chair's signature on the two originals of the Agreement.
2. The Clerk of the Board will forward one fully executed original to the Department for final processing.
