Fiscal Impact/Change to Net County Cost:  No fiscal impact or change to Net County Cost as these services were included in the approved 2012-13 Budget.
 
Background:
The Probation Department has been continuously operating the Electronic Monitoring Program (EMP) since 2006 to provide home detention services as a custody alternative for appropriate low risk offenders.  The department has the necessary expertise in this area and has necessary contracts in place with multiple vendors to provide the electronic and GPS monitoring equipment.  
 
On April 4, 2011, Governor Jerry Brown signed into law Assembly Bill (AB) 109, referred to as 2011 Public Safety Realignment.  AB 109 was later modified by AB 117.  Both bills taken together create extensive changes to existing law which will reduce the number of offenders incarcerated in state prison and "realigns" these offenders to local entities who are now responsible to manage the specified offenders.  
 
Reason for Recommendation:
The County of El Dorado has chosen to contract for electronic monitoring services utilizing the Western States Contracting Alliance (WSCA)/Washington State Contract #14600.  WSCA was formed in October 1993 by the state purchasing directors from fifteen NASPO (National Association of State Procurement Officials) western states.  The primary purpose of creating WSCA was to establish the means by which participating states could join together in cooperative multi-state contracting.  This approach has helped states achieve cost-effective and efficient acquisition of quality products and services.    
 
Western States Contracting Alliance (WSCA) agreement #14600 was amended to add an additional six months to the term, now terminating on June 30, 2013.  El Dorado County's Amendment III revises the term date of Agreement #277-S1010 AMDT I/II to be in alignment with WSCA's agreement #14600.  
 
Action to be taken following Board approval:
1.  Chair shall sign two originals of Amendment III of 277-S1010 upon final approval of Risk Management.
2.  Clerk of the Board shall return one original Amendment III to Probation for distribution to 3M Electronic Monitoring, Inc.
3.  An executed copy shall be forwarded to Procurement and Contracts
