Reason for Recommendation
The Fallen Leaf Lake CSD advised the Elections Department that it had two vacancies on its 5-member Board of Directors, and asked the Elections Department to conduct an election to fill the two vacancies on the next election date, which is March 5, 2013.  Only two candidates submitted declarations of candidacy within the appropriate time period: Lawrence Calof and Stephen A. Malley.  When the number of candidates equals or is less than the number of vacancies, Elections Code 10515 requires that the Board of Supervisors "shall" appoint those candidates to the offices in lieu of conducting the election.  The candidates take office as if they had been elected at a general district election for the office.
The Fallen Leaf Lake CSD has advised that they recently experienced another vacancy on its Board of Directors, thus bringing the membership under a quorum.  However, once the Board of Supervisors makes these two mandatory appointments in lieu of election, the CSD Board will have 4 members and will be restored to a quorum, and then can fill its remaining vacancy by appointment
