Fiscal Impact/Change to Net County Cost
No change to Net County Cost.  There are forty-five signals maintained in El Dorado County, each having either a Conflict Monitoring Unit (CMU) or a Malfunctioning Monitoring Unit (MMU).  The cost of the annual testing and certification for each CMU or MMU is $90.  The estimated annual cost for testing and certification of CMUs or MMUs for forty-five signals is $4,050 and is available in the FY 2012-13 budget and will be included in future budgets covered by this Agreement.  The contract balance is sufficient to cover the cost of the additional services.  No increase to the not-to-exceed amount of the contract is required.
 
Background
On June 21, 2011, the Board of Supervisors awarded the contract for traffic signal maintenance and repair services to Republic Intelligent Transportation Services, Inc. for an amount not to exceed $420,000 for a term of three years.  Republic Intelligent Transportation Services, Inc. merged with Siemens Industry, Inc. effective October 1, 2012.  This Amendment is necessary to reflect this change in ownership.
 
In addition, Transportation's Traffic Operations unit has determined that Conflict Monitoring Unit and Malfunctioning Monitoring Unit testing and certification are required annually for all signals in order to comply with Caltrans regulations.  This Amendment incorporates the new services in Amended Exhibit A, "Amended Scope of Services" and adds the corresponding fees to Amended Exhibit C, "Amended Cost Proposal: Table of Equipment and Labor Rates."
Reason for Recommendation
Transportation recommends the Chair be authorized to sign the First Amendment to Agreement for Services 069-S1211 reflecting the change in ownership from Republic Intelligent Transportation Services, Inc. to Siemens Industry, Inc. and to allow for the additional services required under the Agreement to take place.
The Procurement and Contracts Division concurs with Transportation's recommendation to amend this Agreement.  Operating Engineers, Local No. 3 has been informed of this proposed Amendment.   
 
Action(s) to be taken following Board approval
1) The Clerk of the Board will obtain the Chair's signature on two originals of the First Amendment to Agreement 069-S1211.
2) The Clerk of the Board will return one executed original to Transportation for final processing.
