Fiscal Impact/Change to Net County Cost: No change.  Sufficient appropriations were included in the Fiscal Year ("FY") 2012-13 budget.  Funds are included in FY 2013-14 County Budget Request and will be included in future County Budget Requests.
 
Termination: Agreement includes the County's standard Fiscal Considerations termination language as well as a provision for the County to terminate the Agreement without cause in seven (7) calendar days upon written notice.  
 
Background: On August 16, 2011, the Department of Human Services ("DHS") presented perpetual Agreement for Services 151-S1111 with Guiding Our Youth for the provision of emergency shelter and foster care placements in the not-to-exceed annual amount of $100,000 to the Board for review and approval.  The Board approved and authorized the Purchasing Agent to execute said Agreement, with the perpetual term to begin upon Purchasing Agent execution, which was August 23, 2011 (Legistar File #11-0882, Agenda Item #6).  
 
Reason for Recommendation:
Amendment I to Agreement for Services 091-S1211 requires Board approval and authorization as it increases the annual not-to-exceed amount by $200,000 for a total annual not exceed of $300,000 to allow for anticipated increased utilization of vendor services on an "as requested" basis, updates the vendor's address, and ensures all Articles conform with County-mandated language.  
 
Action to be taken following Board approval:
1) Chair to sign two (2) originals of Amendment I to Agreement 091-S1211.
2) Board Clerk's Office to return one (1) signed original Agreement to HHSA at Briw Road
3) HHSA to distribute as appropriate.
