Title
Chief Administrative Office, Procurement and Contracts Division on behalf of Human Resources, recommending the Board consider the following:
1) Make findings that it is more feasible and economical to engage an outside consultant to provide all professional legal services as a third party for the purpose of advising and assisting the County Civil Service Commission, acting as counsel for the Commission, during hearings of appeals of discipline actions, complaints of unlawful personnel discrimination and other personnel matters pursuant to Board Resolutions or Memoranda of Understandings; and
2) Authorize the Chair to sign Agreement No. 573-S1311 with Liebert, Cassidy, Whitmore, in an amount not to exceed $20,000 for a one (1) year term to provide professional legal advice on an "as requested" basis for the Civil Service Commission.

Fiscal Impact/Change to Net County Cost
Funding is budgeted and available in the Human Resources Department.
Background
Human Resources currently has an agreement with Meyers, Nave, Riback, Silver and Wilson (Agreement #394-S1211) for the term May 1, 2012 through April 30, 2014 for these services. The department has requested Procurement & Contracts to process an agreement with Liebert, Cassidy, Whitmore to provide Human Resources with an additional firm to provide these services.
It should also be noted the County also has the following agreements with Liebert, Cassidy, Whitmore:
Agreement #212-S1310 - Professional services to assist the County with regard to its relationships with various allied agencies for the term of October 12, 2012 through October 11, 2014, with a not to exceed amount of $61,344.00.
Agreement #220-S1311 - Employment relations consulting services for the term of October 1, 2012 through September 30, 2013, with a not to exceed amount of $150,000.00.
Reason for Recommendation
The Board is being asked to make findings that this independent Consultant can more economically and feasibly provide all professional legal services as a third party for the purpose of advising and assisting the County Civil Service Commission, acting as counsel for the Commission during hearings of appeals of discipline actions, complaints of unlawful personnel discrimination and other personnel matters pursuant to Board Resolutions or Memoranda of Understandings.
Action(s) to be taken following Board approval
Procurement & Contracts will process the agreement and provide a copy to Human Resources for administration.
