Reason for Recommendation
Transportation is recommending the Board make findings in accordance with Chapter 3.13, Section 3.13.030 of the County Ordinance that it is more economical and feasible to engage an independent contractor for on-call application of Type II/Latex Modified Slurry seal over chip seal surfaces on various County roads because there are specialty skills required for the work to be performed under this Agreement that are not expressly identified in County classifications.  Under the proposed Agreement, Intermountain Slurry Seal, Inc. will furnish personnel, equipment, vehicles, materials, supplies, and services necessary to provide application of Type II/Latex Modified Slurry Seal over chip seal surfaces on various County roads on an on-call basis.  Specialized equipment and training are required for mixing and application of the material over large areas.  Transportation does not have the equipment or the expertise required for applications of slurry seal.  This type of treatment is only used on certain types of roads and on a seven to ten year cycle.  The volume of slurry seal work in the proposed contract is to begin addressing deferred maintenance.  Services shall be provided pursuant to written Work Orders for each assignment and in accordance with the rates identified in Exhibit A of the Agreement.
 
The work to be performed under this agreement falls under services as defined in Government Code Section 31000.  Contracts for such services do not require a competitive bidding process under the County Purchasing Ordinance and Procurement Policy; however, for any contact over $100,000 the contractor selection process must include a review of the scope of services and the contractor's professional qualifications. This review shall be performed by a group of individuals uniquely qualified to judge the contractor's ability to perform the services. The group must include at least one representative from outside the department requesting the services.  Transportation staff selected Intermountain Slurry Seal, Inc. to perform the services based on work that the Contractor has performed for the County in the past and an outside review by Teri Martinetti from the City of Reno.  In Ms. Martinetti's letter of recommendation, she described the work that Intermountain Slurry Seal, Inc. performed for the City of Reno from 2007 through 2012.  Specifically, she noted that the projects overall were completed on time and within budget and that the weekly work schedules were generally appropriate in size to enable completion, minimizing the need for rescheduling, and thus minimizing the inconvenience to residents and businesses.
 
This Agreement is necessary to begin work as soon as possible for the 2013 road maintenance season.  Transportation is working with the Procurement and Contracts Division to conduct a formal competitive process for the award of additional/future agreements.
 
Operating Engineers Local Union #3 has been informed of the proposed Agreement.
 
Action(s) to be taken following Board approval
1. The Clerk of the Board will obtain the Chair's signature on the two originals of the Agreement, subject to review and approval by County Counsel and Risk Management.
2. The Clerk of the Board will forward one fully executed Agreement to Transportation for further processing.
