Background
The owner and operator of the Black Sheep Casino has requested amendments to the County’s existing cardroom ordinance codified in Chapter 9.45 of the El Dorado County Ordinance Code. Black Sheep Casino is the only licensed cardroom in the County and will remain so until at least 2020 due to a state moratorium on the issuance of new cardroom licenses.

As required by state law, the proposed amendments were submitted to the California Department of Justice, Bureau of Gambling Control (Bureau) for review and comments. The proposed amendments involve: (i) increasing the total number of authorized card tables from the current seven tables to eleven tables; (ii) adding clarifying language in County Ordinance Code section 9.45.090 that restriction on transferring a cardroom license does not extend to a prohibition on a sale of the business or change in ownership of the cardroom; and (iii) deleting the first sentence in County Ordinance Code section 9.45.100 which would allow any future relocation of the business to be done pursuant to a single application to the state and to the County instead of separate requests for approval of a change in location.

The Bureau has offered its comment on the proposed amendments, noting that the permissible number of increase is only three tables, from seven to ten, instead of the proposed increase to eleven tables. Black Sheep Casino has no objection to increasing the number of card tables to ten in accordance with the Bureau’s comment.
