There is no Net County Cost associated with this Agreement.  Sufficient appropriations were included in the Fiscal Year ("FY") FY 2013-14 Budget Request, and will be included in the FY 2014-15 Budget Request.
 
Background
The Health and Human Services Agency ("HHSA") has contracted with Marshall Medical Center ("Marshall") for the provision of miscellaneous laboratory, pathology, and x-ray diagnostic services on an "as requested" basis since 2005.  Agreement for Services 024-S1010 with Marshall for these services was executed by the County Purchasing Agent on June 28, 2010 and its Amendment I was also executed by the Purchasing Agent on October 29, 2012.
 
This Amendment II to that Agreement for Services 024-S1010 incorporates language to clarify the process by which Marshall may outsource diagnostic testing services not available at the Marshall facility, updates the "Compensation for Services" language, extends the term of the Agreement to cover the period June 28, 2010 through May 31, 2015, and increases the maximum obligation of the Agreement to $100,000.  This Agreement is being submitted retroactively for County execution due to longer than anticipated development and processing times.
 
Reason for Recommendation
California Health and Safety Code Sections 120100-121525 require various actions and responses on behalf of the County Health Officer and agents of the Health Services Division of HHSA to protect and safeguard the public from disease. The ability to carry out these legal responsibilities requires access and availability to medical diagnostic specialty services that cannot be provided through the County. In addition, the County maintains facilities where medical/psychiatric services are provided to clients where medical monitoring necessitates access to diagnostic services. Failure to obtain these services would prevent the Health Officer and associated agents of public health in expediently identifying infectious disease or conditions that would jeopardize the health and safety of the public.
 
Approval of this Amendment II to Agreement 024-S1411 will ensure ongoing access to laboratory, pathology and x-ray services through Marshall Medical Center which cannot be provided by the County Public Health Laboratory.
 
Action(s) to be taken following Board approval
1) Chair to sign two (2) original Amendment II to  Agreement 024-S1010;
2) Board Clerk to return one (1) signed original Amendment II to Agreement 024-S1010 to HHSA, Contracts Unit, at 3057 Briw Road, Suite A;  
3) HHSA to distribute documents as appropriate.
