Title: Health and Human Services Agency recommending the Board consider the following: 1) Authorize the Chair to sign Agreement 396-S1311 with Maxim Healthcare Services, Inc., to provide temporary personnel to supplement the Psychiatric Health Facility and Psychiatric Emergency Services staffing on an “as requested” basis. There is no Net County Cost associated with this Agreement 396-S1311.  Sufficient appropriations were included in the Fiscal Year 2013-14 Budget Request, and will be included in subsequent Budget Requests for the term of the Agreement.
 
Background
Maxim Healthcare Services, Inc. provides temporary employees to augment County personnel for the Psychiatric Health Facility ("PHF") or for Psychiatric Emergency Services ("PES").  Temporary staffing provided under this Agreement are typically registered nurses ("RN"), licensed vocational nurses ("LVN"), and mental health workers ("MHW").  Health and Human Services Agency, Mental Health Division ("HHSA") is able to use Maxim as a relief pool to meet the staffing and licensing requirements mandated by the State and by critical needs such as "one on one" supervision.
 
Title 22, California Code of Regulations ("CCR"), Section 77061 speaks to the staffing requirements for licensing of Psychiatric Health Facilities.   CCR Section 77601 (f) states "During the absence of any staff required in subsection (h)(1) below there shall be a substitute person with the required qualifications to provide the number of hours of services required."  Despite ongoing recruitment efforts to hire qualified, permanent RNs, LVNs and MHWs, the Mental Health Division has intermittently struggled to maintain full staffing at the PHF for many years, and has successfully contracted with Maxim Healthcare Services, Inc. to fill gaps in staffing on an "as needed" basis since 2006.
 
Reason for Recommendation
Approval of this Agreement 396-S1311 will ensure sufficient supplemental staffing for the PHF and PES services on an "as requested" basis.   
 
In accordance with Board of Supervisor's Procurement Policy C-17 Section 7.10, HHSA coordinated the outside review of the scope of services along with the Contractor's qualifications and has provided the results to the Procurement & Contracts Division.
 
Action(s) to be taken following Board approval
1) Chair to sign two (2) original Agreements 396-S1311.
2) Clerk of the Board to return one (1) fully executed original Agreement to HHSA at 3057 Briw Road, Suite A.
3) HHSA to distribute documents as appropriate.
