Fiscal Impact/Change to Net County Cost
Funding is available in Fiscal Year 13/14 and will be inlcuded in the Agency's FY14/15 and 15/16 budget requests. There is no change in Net County Cost.
 
Background
In 2007, at the request of the Environmental Management Department, the Procurement and Contracts Division issued a Request for Qualifications (RFQ) and Statement of Interest for the purpose of hiring multiple contractors to provide construction maintenance at the Union Mine Disposal Site on an as-needed basis.  Five (5) responses were received, evaluated by a committee, and a recommendation to execute agreements with Doug Veerkamp General Engineering, Joe Vicini, Inc., and Macauley Construction was presented to the Board of Supervisors on August 24, 2010, Legistar item #11.  Subsequently, the Board Chair executed all three (3) agreements for a three (3) year term, in the amount of $300,000 each.  Services requested were alternated between the Contractors depending on their current workload and labor force.
 
For the past three (3) years the Environmental Management Division (EMD) primarily used Dough Veerkamp General Engineering, Inc., and Joe Vicini, Inc., and has been satisfied with the work performed.  Both contractors have particular knowledge of, and experience with, landfill facilities and operations.
 
On July 17, 2013, the Community Development Agency, Administration and Finance, Contract Services Unit, requested a scope and qualification review waiver request under Procurement Policy C-17, Section 7.10, Contracts over $100,000, from the Purchasing Agent.  On August 5, 2013, Procurement & Contracts approved the waiver request.  A Feasibility Analysis was routed along with each contract to Human Resources/Risk Management, and County Counsel, and was approved on October 25, 2013.
 
Reason for Recommendation
EMD is requesting to enter into new three (3) year agreements with Doug Veerkamp General Engineering, Inc. and Joe Vicini, Inc., for a total not to exceed amount of $300,000 each.  An outside independent contractor can more economically and feasibly perform the work in accordance with County Ordinance Chapter 3.13 as EMD does not possess the trained personnel or equipment necessary to perform the construction maintenance work.
 
The County Officer or employee with responsibility for administering this agreement is Greg Stanton, Deputy Director, EMD, Community Development Agency, or successor.
 
Action to be taken following Board approval
Board Clerk to provide one set of fully executed Agreements to EMD for distribution, encumbrance and administration.
