Title
Community Development Agency, Environmental Management Division, recommending the Board adopt Resolution 176-2013 to:
1) Accept grant funds from the State of California, Health and Human Services Agency, Department of Public Health (Grant Funding Agreement), in the amount of $232,500, under the California Safe Drinking Water Revolving Act (HSC 116270 et. seq.) for the enforcement of the California Safe Drinking Water for Small Public Water Systems;
2) Delegate authority to the Community Development Agency Director, or designee, to execute the Grant Funding Agreement, Claim Form, Local Primacy Delegation Agreement, Confidentiality Agreement, and all associated reports and documents necessary to administer the Grant Funding Agreement;
3) Authorize the Community Development Agency, Assistant Director of Administration and Finance, or successor, signature authority to execute the Fiscal Agent Agreement; and
4) Approve the establishment of a non-interest bearing trust fund in which to deposit the Grant funding titled "California Department of Public Health - State Revolving Fund Grant".
 
The authorization provided under the Resolution is effective for twelve (12) months from the date of adoption or until the Fiscal Agent has disbursed the entire Grant Amount, whichever occurs first.
 
FUNDING:  Federal Safe Drinking Water Act, 42 U.S.C. 300 j-12 et. seq., and the Safe Drinking Water State Revolving Fund Law of 1997, Health and Safety Code, section 11670.10 et seq., and in conformance with the Local Primacy Agency Program (Federal Funds).

Fiscal Impact/Change to Net County Cost
There is no change in Net County Cost.  The grant funding was included in the Agency's FY 2013-14 Budget.  No matching contributions are required for these grants and payment programs.
 
Background
The Environmental Management Division (EMD) has been working under an existing agreement with the California Department of Public Health (CDPH) that was signed in 1993.  That agreement delegated to the County the authority as the Local Primacy Agency (LPA) to implement the California Safe Drinking Water Revolving Act (SDWA) for small public water systems.  The LPA ensures a safe drinking water supply to the public from small public water systems defined by the LPA Delegation Agreement.
 
The Grant amount allocated to each County is calculated on the number and type of small water systems, and is non-competitive.  EMD currently permits, inspects, and oversees monitoring and maintenance of small public water systems that are located within the County.
 
The term of this Grant Funding Agreement is for one year from the date of execution, or until the Fiscal Agent has disbursed the entire grant amount, whichever occurs first.
 
Reason for Recommendation
The CDPH through the LPA delegation agreement authorizes the Environmental Management Division to implement SDWA requirements for small public water systems in the County of El Dorado.  Grant funding will be used to implement the program, including, but not limited to, staff time to conduct inspections of small water systems; review water system operations and equipment; review monitoring requirements and update as needed; update database records; and complete required reporting to CDPH.
 
In accordance with BOS Policy A-6, the Board of Supervisors is the sole authority for accepting grant awards and approving grant agreements.  After acceptance of a grant award and approval of the grant agreement, the Board may delegate authority to execute the grant agreement and other grant related documents.  The attached Resolution allows the Community Development Agency (CDA) Director or designee signature authority to execute all documents, including, but not limited to, Grant Funding Agreement; Claim Forms; Local Primacy Delegation Agreement (LPDA) and attached Confidentiality Agreement.  In addition, the Resolution gives the CDA, Chief Fiscal Officer, authority to sign the Fiscal Agent Agreement.
 
In accordance with the Fiscal Agent Agreement (attachment three [3] to the Grant Funding Agreement), the State will make a lump sum grant payment in trust that will be deposited in a non-interest bearing account.  The CDA, Chief Fiscal Officer, will be the Fiscal Agent to assist in holding and managing the grant amount in trust, and disbursing grant funds to County upon instruction by State.
 
Action to be taken following Board approval
Board Clerk to provide one fully executed Resolution to EMD to insert into the Grant Agreement as attachment one (1) to the Agreement.
