Fiscal Impact/Change to Net County Cost
Community Development Agency, Transportation Division (Transportation) has included $129,920 in its Fiscal Year 2013-2014 budget and anticipates budgeting the remaining amount in subsequent fiscal years.  Funding for proposed Agreement has been included in the individual budgets for Capital Improvement Program (CIP) projects and will be provided by Traffic Impact Mitigation (TIM) fees and State and Federal CIP project funding.  There is no Net County Cost.
 
Reason for Recommendation
Transportation is requesting approval of the subject Agreement with the State of California - Department of California Highway Patrol (CHP) for a four-year term with a retroactive start date of July 1, 2013 and a not-to-exceed compensation amount of $324,800 for traffic control and enforcement services. When requested by Transportation, traffic control and enforcement services will be provided by CHP during construction phases of various CIP construction projects in El Dorado County.  During construction on CIP projects, lane closures and full road closures are sometimes necessary to ensure motoroist safety and worker safety.  During certain closures, such as freeway lane closures, full closures of County roads, weekend closures, and closures under heavy traffic, having CHP officers on site provides a significant deterrent against reckless driving through construction zones.
 
The projects for which Transporation anticipates requesting services under the proposed Agreement include but are not limited to the following:
 
·      U.S. 50 HOV Lanes Phase 0
·      U.S. 50/Silva Valley Parkway Interchange
·      U.S. 50/Missouri Flat Road Interchange Improvements - Phase 1B
·      Pleasant Valley Road (SR 49)/Patterson Drive Intersection Signalization
·      Green Valley Road/Deer Valley Road West Intersection Improvements
·      Pleasant Valley at Oak Hill Road Intersection Improvements
·      Sly Park Road at Clear Creek - Bridge Replacement
·      Bucks Bar Road at North Fork Cosumnes River - Bridge Rehabilitation
·      Salmon Falls Road South of Glenesk Lane Realignment
·      Cold Springs Road Curve Correction
·      Silver Springs Parkway/Green Vly Rd Intersection Signalization
·      Diamond Springs Parkway - Phase 1A - SR-49 Realignment
·      Green Valley Road at Weber Creek - Bridge Replacement
 
Pursuant to the El Dorado County Charter, Article II, Section 210 b (6), the County may enter into any contract or agreement in cases where the agreement is with or among any other governmental entities or agencies.  The El Dorado County Deputy Sheriff's Association (DSA) has been notified of this proposed Agreement.
 
Transportation is also requesting the Board delegate signature authority for both the Agreement and the attached Certification to the Acting Community Development Agency Director.  This request is being made because the signature blocks on the Agreement and the Certification cannot be modified and there is not enough room to accommodate both the Board Chair's signature and Clerk of the Board's signature.  In addition, a Certified Minute Order from the Clerk of the Board is requested by Transportation to attach to the Agreement and submit to CHP.
 
Board of Supervisors Policy C-17 requires the Board of Supervisors approval for contracts exceeding three years; therefore, Transportation is seeking Board approval since the terms of the Agreement exceeds three years
 
Action(s) to be taken following Board approval
1.  The Clerk of the Board will forward the Agreement and the Certification to Transportation for execution by the Acting Community Development Agency Director.
2.  The Clerk of the Board will forward a Certified Minute Order to the Transportation Division for further processing.
