Fiscal Impact/Change to Net County Cost
There is no change in Net County Cost.  This Agreement is initially funded by the Rare Plant Mitigation Fund.  The Rare Plant Mitigation Fund would be reimbursed out of the fee program to be developed.
 
Background
On May 15, 2012, the County Board of Supervisors executed Agreement 579-S1211 with Science Applications International Corporation (SAIC) for a 2-year term with a not to exceed amount of $190,634 to provide biological and related scientific consulting services.
 
Effective September 27, 2013, SAIC has separated into two independent companies: SAIC and Leidos, Inc., resulting in this First Amendment to the Agreement.
 
Reason for Recommendation
The purpose of this First Amendment to the Agreement is to assign the agreement to Leidos, Inc., with related amendment to the Article: Notice to Parties.  The parties also mutually agree to add to the contract Articles for: Change of Address, Audit by California State Auditor, No Third Party Beneficiaries, Counterparts, and Taxes, to reflect current County contract provisions.
 
All other terms and conditions of the agreement are unchanged. Maintaining this Agreement will allow the County to continue the direction of the Board from May 15, 2012 to prepare analysis to support the eventual preparation of an application for a Section 2081 Permit under the California Endangered Species Act and an agreement with the California Department of Fish and Wildlife to comply with the Native Plant Protection Act.
 
Action(s) to be taken following Board approval
1. The Clerk of the Board will obtain the Chair's signature on the First Amendment to Agreement for Services 579-S1211; and
2. The Clerk of the Board will forward a fully executed copy of the Agreement to Development Services Division for distribution, encumbrance, and administration.
