There is no Net County Cost associated with this gift of funds.  The Budget Transfer will adjust the Agency's FY 2013-14 Aging Programs Budget by increasing miscellaneous donations revenue and special departmental expense appropriations in the amount of $225,000.
 
Background
The Ruth Sherrard Revocable Trust of 2012 (Trust) named Senior Legal Services, El Dorado County Health and Human Services Agency (HHSA), as a residual beneficiary.  As such, under the terms of the Trust, Senior Legal Services of the HHSA is entitled to ten percent (10%) of the residual estate of the Trust.  
 
Pursuant to Government Code section 25355, the Board "may accept or reject any gift, bequest, or devise made to or in favor of the county or to or in favor of the board in trust for any public purpose."  However in accepting the gift, "The board may hold and dispose of the property… for those lawful uses and purposes as are prescribed in the terms of the gift, bequest, or devise."  In contrast, under Government Code section 25356, where the gift, bequest or devise does not limit the uses to which the gift can be put, the gift shall be deposited in the General Fund and the county is free to use the funds for any lawful public purpose.  
 
Reason for Recommendation
The HHSA is recommending the Board accept this generous gift in honor of Ruth Sherrard, in keeping with her intent to support Senior Legal Services within HHSA for legal assistance services provided to seniors in El Dorado County.  At a future date HHSA will return to the Board of Supervisors with a recommendation of how the funds should be spent to support Senior Legal Services.
