Fiscal Impact/Change to Net County Cost:  There will be no impact to net county cost for either department.  All services rendered from the Department of Justice will be paid for through the Proposition 69 monies which reside in a special revenue fund.  
 
The DNA special revenue is under the control of the Sheriff's office (7724354).  The Sheriff's Fiscal Unit and District Attorney's office will work together to ensure proper invoicing.  The invoice will be submitted to the Sheriff's Office for payment.
Background: Proposition 69 requires "an additional penalty of $1 for every $10, or part of $10, in each county upon every fine, penalty, or forfeiture imposed and collected by the courts for all criminal offenses."  These funds are then deposited into a special revenue fund and are prohibited from use except for the collection, processing, analysis and tracking of DNA specimens.  
 
Under this MOU the County Board of Supervisors is authorizing payment to the Department of Justice for the analysis, issuance of reports on the analysis, tesimony in court when necessary along with quarterly training for law enforcement personnel in the recognition, collection, and proper storage of biological/DNA evidence.
Reason for Recommendation:  Under the proposed MOU the County of El Dorado will acquire the use of one full-time Senior Criminalist within the Department of Justice.  This acquisition will allow for the expedited processing of DNA collected in criminal cases which under the current system are backlogged at the Department of Justice.  In addition, the processing and analysis of DNA from the Senior Criminalist will result in more timely and highly regarded testimony in court.
Action to be taken following Board approval:  Amendment to be signed by Chairman and forwarded to the District Attorney's Office for submittal to the California Department of Justice.
