Fiscal Impact/Change to Net County Cost
There is no Net County Cost associated with this Agreement.  Sufficient appropriations are included in the Fiscal Year 2013-14 budget and will be included in future County budget requests.  If changes in funding occur in future FYs, the amount of the agreement will be adjusted appropriately.
 
Background
Welfare and Institutions (W&I) Code Section 5897 directs the State to implement the mental health services defined in the W&I Code Section 5800 (Adult and Older Adult Mental Health System of Care Act), Section 5840 (Prevention and Early Intervention Programs), and Section 5850 (The Children's Mental Health Services Act) through contracts with county mental health programs or with counties acting jointly.  
 
The Health and Human Services Agency (HHSA), on behalf of the County, contracts with the State to serve as the Mental Health Plan (MHP) for the County.  HHSA, as the MHP, contracts with as many long-term residential treatment and inpatient psychiatric hospital facilities as possible, to ensure availability of services on an "as needed" basis, in accordance with Title 9, California Code of Regulations Sections 1700-1799.  
 
Crestwood Behavioral Health, Inc. (Crestwood) offers multiple levels of mental health services including; 1) Mental Health Rehabilitation Center (MHRC) facilities licensed by the State of California to provide twenty-four (24) hour intensive support and rehabilitation services designed to assist clients 18 years or older with mental disorders in the development of skills to become self-sufficient and capable of increasing levels of independent functioning; and 2) Psychiatric Health Facility (PHF) services.  The HHSA, Mental Health Division does not have long-term residential facilities and must contract for these services.  In addition, this Agreement 421-S1411 provides access to the Crestwood PHF facilities in the event there is insufficient capacity at the County PHF.
 
Crestwood requested additional language be added to the indemnity article (Article XXII), which indemnifies and holds harmless Crestwood.  Agreement for Services is retroactive due to contract negotiations with vendor.
 
Reason for Recommendation
Approval of this Agreement will ensure availability of long-term residential treatment and inpatient psychiatric health facility services.  Failure to approve this Agreement would limit the County's access to services and diminish the County's ability to provide services required of the MHP.  HHSA currently has clients placed with Crestwood.

2. Clerk of the Board to return one (1) fully executed Agreement to HHSA at 3057 Briw Road.
