Title
County Counsel recommending the Board approve and authorize the Chair to sign Agreement 161-S1511 with the law firm of Downey Brand for advisory and litigation legal services in regard to bankruptcy and tax collection proceedings as needed for a term beginning upon execution and until terminated by one or both parties, subject to non-substantive revision should minor changes be needed prior to execution. The Agreement shall be effective upon execution and remain in effect until terminated. An initial appropriation of $30,000.00 is included in the Treasurer/Tax Collector's Fiscal Year 2014/2015 budget for services under this Agreement.

Fiscal Impact/Change to Net County Cost
No change to Net County Cost. The costs will be borne by departments using the services. An initial appropriation of $30,000.00 has been made in the Treasurer/Tax Collector's FY 2014-15 budget and if additional funds are needed Board approval will be obtained.
Reason for Recommendation
Bankruptcy and tax collection proceedings require unique legal expertise and skills of specialists who routinely work in these areas of the law. The Treasurer/Tax Collector has required immediate action in regard to these issues in the past.
Clerk of the Board Follow Up Actions
1. Upon receipt of final Agreement 161-S1511 and the contract routing sheet for same, the Clerk will obtain the signature of the Chair on two original agreements.
2. Clerk of the Board will return one (1) fully executed original Agreement 161-S1511 to County Counsel.
