RECOMMENDED ACTION: Approve.

Fiscal Impact/Change to Net County Cost:
 
The proposed action does not change the amount of the STIP funding for Phase 1B but instead results in a timing change for the allocation of those funds where the monies will be provided during the construction phase versus the earlier planning and design phases of the project.  As a result, the 2004 General Plan Highway 50 TIM will absorb early soft costs with STIP monies funding the  construction costs.
 
There is no net cost to the County General Fund associated with this agenda item.
 
Background:
 
The Missouri Flat Road Interchange Improvements Phase 1 Project has been segmented into two sub-phases, Phase 1A and 1B.  Phase 1A is currently under construction and is anticipated to be complete by the end of the 2008 construction season.  Phase 1B is currently in the PS&E and ROW acquisition stages of project development with construction anticipated to begin, on-schedule, in 2009.  
 
Funding for Phase 1B includes $22.009 million in STIP funds ($1.475 million PS&E, $1.1 million ROW, $19.434 million construction).  Additional funding for the project is local MC&FP, TIM and approximately $2.864 million in state SHOPP funds.  The Department is pursuing additional funding sources, and upon completion of an updated cost estimate (Currently scheduled to be complete in March 2008) and clarification of additional grant funding sources, the project scope will be adjusted, if necessary, to match available funds.
 
Exhibit "A" summarizes the revised programming request.
 
Reason for Recommendation:
 
The purpose of this AB3090 STIP Amendment Request is to transfer funds programmed for PS&E and ROW to construction in FY 2008/2009.  Currently, the portions of PS&E and ROW costs which are fundable under the STIP program are less than previously anticipated, and will not fully utilize the programmed amount ($2.575 million programmed vs $1.5 million reimbursable cost).  STIP funding regulations prevent unutilized allocations from being transferred to future phases of the project (construction in this case).  If the programmed amount is allocated, the unused portions of those funds will be lost to the County ($2.575 million - $1.5 million = $1.075 million lost to County).    If the programmed funds are transferred to Construction prior to allocation to PS&E and ROW, the full $2.575 million can be utilized in construction.  
 
Multiple conversations have been held with EDCTC, Caltrans and CTC staff to discuss the options available to the County.  CTC staff suggested that given the current funding shortfall in the STIP, the  reprogramming of these funds to construction, may increase the likelihood that the construction funds ($22,009,000) will be allocated in FY 2008/2009 as requested (A discretionary action by the CTC which is not guaranteed).  This AB3090 STIP amendment was the consensus recommendation to allow the County to take full advantage of available STIP funding.  
 
Action to be taken following Board approval:
 
The Department will submit to the EDCTC an AB3090 STIP Amendment request, including a request for commitment of future shares of STIP funds to the Missouri Flat Road Interchange Improvement Phase 1B Project.
