Fiscal Impact/Change to Net County Cost
The program will fund financial incentives for projects that reduce emissions from internal combustion engines.  Allotments to administering air districts are provided on an annual basis. The Fiscal Year (FY)14/15 El Dorado County (EDC) allotment will be approximately $339,973.  Ten percent of the annual allotments will fund the cost of program administration.  Revenue from the FY 14/15 cycle is expected to be received after the current FY is completed; therefore revenues and expenditures associated with the Program will be budgeted in the FY 15/16 budget.
Background
Western EDC is categorized as serious non-attainment of the state 1-hour ozone Ambient Air Quality Standard (AAQS) and severe non-attainment of the federal 8-hour ozone AAQS.  The Lake Tahoe area is in transitional non-attainment of the federal 8-hour ozone AAQS.  Ozone is formed by the reaction of nitrogen oxides (NOx) with volatile organic compounds (VOCs) in the presence of sunlight.  The primary source of NOx and VOCs in El Dorado County is motor vehicle fuel combustion.  
 
The Carl Moyer Program was established by the California Legislature in 1998 and was modified in 2001 (AB1390), 2004 (AB923 and AB1394), 2005 (SB467), 2006 (SB225), 2009 (SBX2-3), 2010 (AB1507) and 2013 (AB8). With the passage of AB8 in 2013, the California Legislature reauthorized annual Carl Moyer Program funding through January 1, 2024.  
 
Currently, the program is designed to reduce the emissions of NOx, VOCs and particulate matter (PM) from combustion engines. Program criteria are established in statute and by detailed program guidelines developed by CARB.  Each air district is eligible for a minimum annual allotment of $200,000, plus additional funds based on population and air quality.  The program is funded by a portion of the smog abatement fee in the annual registration of newer vehicles ($6) and through a fee on the sale of new tires ($0.75).  
 
For the first 16 years of the program, EDC allotments were administered by the Sacramento Air Quality Management District (SMAQMD).  SMAQMD utilized these funds for numerous projects in EDC and upwind of EDC in the Sacramento Federal Non-Attainment Area (Sacramento County, Yolo County and portions of Placer, Sutter, Solano and El Dorado counties).  
 
Funds can be used for a variety of purchase, re-power, or retrofit projects including those for agriculture pumps, locomotives, marine vessels, off-road construction/ agriculture vehicles and on-road heavy duty vehicles.  Funds may also be used for voluntary accelerated vehicle retirement (car scrap) programs.  Projects must be cost effective. The current (14/15) cost effectiveness threshold is $17,720 per ton of emissions reduced.   Projects must be "surplus" meaning that they must not be undertaken to comply with any federal, State or local regulation or other legal mandate.
Reason for Recommendation
AQMD has been successfully implementing several emission reduction grant projects including the AB 923 (school bus), AB 2766 (motor vehicle emission reduction), Chimney Smoke reduction, Lawn Mower exchange, Drive Clean electric vehicle incentive and electric vehicle charging infrastructure grants from the California Energy Commission, Indian Gaming Commission and El Dorado County Transportation Commission (EDCTC).  The EDCTC Congestion Management Air Quality grant received by AQMD will also help fund the upgrade of the County fleet.  AQMD administration of Carl Moyer will more directly improve EDC air quality, benefit EDC public and private entities and fund AQMD operations.
 
CARB provided model Resolution language for district governing boards to establish program implementation authority, streamline administration, reduce costs, and provide certainty for multi-year program planning. The attached resolution provides the APCO direction and authorization to annually apply for Carl Moyer funds and undertake all activities needed to administer those funds.
 
Recommended Actions
Adopt Resolution approving the District's participation in the Carl Moyer Grant Program for clean air programs and authorizing the Air Pollution Control Officer to: (1) annually file an application with the California Air Resources Board (CARB) for Carl Moyer Program funds through the statutory term of the program; (2) execute any funding agreements with CARB and other necessary actions to receive allocated funds through the statutory term of the program; (3) implement and expend the funds through grant and incentive programs in accordance with CARB guidelines, (4) execute grant and incentive funding agreements, subject to approval of County Counsel and Risk Management; and (5) match the Carl Moyer funds received from CARB with local AB 923 funds, as may be required.
