Background
In December 2013, the Community Development Agency (CDA) issued a Request for Qualifications (RFQ) to establish a list of qualified firms for twenty-six (26) categories of professional services.  In accordance with procurement Policy C-17, Section 7.10, Request for Qualifications, the CDA formed an evaluation committee.  The committee reviewed responses for the category of laboratory testing and sample analysis.  It was determined that California Laboratory Services (CLS) was the sole qualified proposer for this category.  The evaluation for this category was based on specific experience to successfully provide the full range of services; demonstration of management and organizational ability relative to time management, scheduling and staff/client relationships; history of repeat business with clients; demonstration of understanding community social relationships and citizen's environmental concerns; and amount of work performed internal to the prime consultant.   
 
CDA, Environmental Management Division (EMD) has worked with CLS for the past three (3) years.  Services provided by CLS include courier service at no additional charge for the safe collection and analysis of groundwater, surface water, storm water, wastewater, soil, hazardous materials and hazardous waste sample testing.  Varying degrees of analytical testing of groundwater, surface water, wastewater, storm water, soil hazardous materials and hazardous waste is required either by law, permit and/or public safety.  In addition to the Union Mine Disposal Site, waste discharge requirements, EMD is certified by the State of California Environmental Protection Agency to implement the hazardous materials regulatory programs, including the hazardous materials storage, hazardous waste generators, hazardous waste onsite treatment, and underground storage tank programs.    
 
Reason for Recommendation
EMD is requesting to enter into a contract with CLS to provide a variety of analytical testing for the Union Mine Landfill, Union Mine Wastewater Treatment Facility, Meyers Landfill, hazardous materials programs, environmental health programs, and the storm water program within the CDA Long Range Planning Division.  Without these services, EMD would not be in compliance with state and federal requirements, nor have the resources to request routine and as needed testing services.
Varying degrees of analytical testing of groundwater, surface water, wastewater, storm water, soil, hazardous materials and hazardous waste is required either by law, permit and/or public safety.  In addition to the Union Mine Disposal Site waste discharge requirements, the EMD is certified by the State of California, Environmental Protection Agency to implement the hazardous materials regulatory programs, including the hazardous materials storage, hazardous waste generator, hazardous waste onsite treatment, and the underground storage tank programs.
 
The County's Laboratory cannot perform approximately 98% of the tests required, does not have a courier service to pick-up samples from various sites, and does not provide after hours, weekend and emergency testing.  Therefore, County staff could not provide all the required tests and related services provided under this agreement.
 
Your Board is being asked to make findings that it is more economical and feasible to obtain an outside contractor to provide safe collection and analysis of groundwater, surface water, storm water, wastewater, soil, hazardous materials and hazardous waste sample testing required either by law, permit and/or public safety rather than create new County job classifications and procure specialized laboratory equipment necessary to perform these services.
 
Clerk of the Board Follow Up Actions
1) The Clerk to obtain the Chair's signature on two (2) originals of the agreement; and
2) The Clerk  will forward one (1) original agreement to the EMD for distribution.
