Fiscal Impact/Change to Net County Cost
There are no fees or assessments relative to the subject License Agreement.  The proposed improvements to the California Tahoe Conservancy (CTC) parcels are budgeted in the current Capital Improvement Program and contribute to the County's compliance with its National Pollutant Discharge Elimination System permit.  Future maintenance of the improvements will be accommodated within the Transportation Division's existing operating budget.
 
Background
The Transportation Division (Transportation) will begin construction as early as August 20, 2015 on the Tahoe Hills Erosion Control Project (Project).  Project improvements include grading and revegetation activities, drainage improvements, and erosion control features.  Installation and subsequent long term maintenance of some of these project improvements are on CTC owned parcels (Assessor's Parcel Numbers 016-062-06 and 016-562-09).  Exhibits B-1 through B-2 of License Agreement CTC Resolution #15-02-03_El Dorado County (License Agreement) further describe the proposed improvements planned for these parcels.
 
Reason for Recommendation
Access to the CTC parcels is required for the design, construction, and maintenance of some of the improvements proposed by the Project.  Execution of the License Agreement is required in order for Transportation to access the CTC owned parcels.  
 
Clerk of the Board Follow Up Actions
1. The Clerk of the Board will obtain the Chair's signature on each of the two (2) originals of the License Agreement.
2. The Clerk of the Board will complete the All Purpose Notary Acknowledgment provided.
3. The Clerk of the Board will send the two (2) originals of the partially-executed License Agreement and the All Purpose Notary Acknowledgment to Transportation for processing to the CTC for signature.
 
Action(s) to be taken by Transportation following Board approval
1. Upon receipt of the signed original from the CTC, Transportation will send the License Agreement to the Recorder Clerk's office for recordation.
2. Following recordation, Transportation will forward the fully-executed original to the Clerk of the Board's office.
