Title: Health and Human Services Agency, Public Health Division, recommending the Board adopt Resolution 038-2015 to: 1) Approve and authorize the Health and Human Services Agency to submit Local Enforcement Agency Grant Program applications to California Department of Resources Recycling and Recovery to assist in the costs of the solid waste facilities permit and inspection program commencing with the 2015/16 Local Enforcement Agency Grant through the 2019/20 Local Enforcement Agency Grant with an estimated grant amount of $18,500 for Fiscal Year 2015/16; and 2) Authorize the Health and Human Services Agency Director, or designee, to execute in the name of the County of El Dorado all grant documents, including but not limited to, applications, agreements, amendments and requests for payment necessary to secure grant funds, implement the approved grant projects and close out each grant. Fiscal Impact/Change to Net County Cost
There is no Net County Cost associated with this revenue Agreement.  Sufficient appropriations will be included in the Fiscal Year (FY) 2015-16 Budget and in future FY Budget requests.
 
Background
The County of El Dorado is mandated by the State to have a Local Enforcement Agency (LEA) to oversee the enforcement of solid waste laws and this function is the responsibility of the Community Development Agency, Environmental Management Division.
 
However, El Dorado County has operated Union Mine Landfill since 1962 under the oversight of the Environmental Management Division.  The Union Mine Landfill ceased operating as a public disposal facility in 1996.  In approximately 1994, it was determined that the enforcement of solid waste laws by the Division that operates the Landfill could present a conflict of interest, so the function of ensuring solid waste management oversight was transferred to the Public Health Department (now the Public Health Division of the Health and Human Services Agency).   Since that time, solid waste management oversight for the County of El Dorado has been handled via contract with the Placer County Environmental Management Services.  In addition, the responsibility for the annual grant application to the California Department of Resources Recycling and Recovery (CalRecycle) has been the responsibility of Public Health.
 
CalRecycle offers a LEA grant program to assist LEAs with the cost of solid waste permit and inspection programs. The application requires that a resolution, effective up to five years, and authorizing and identifying a signature authority be submitted with the annual application.  
 
This requirement has been met in the past through Resolution 099-2003 (expired Fiscal Year 2008-2009) and Resolution 116-2009 (expires October 28, 2015 - the end of the Fiscal Year 2014-2015 grant period.).
 
Reason for Recommendation
HHSA recommends approval of this Resolution to continue to meet CalRecycle's requirement that a resolution be in place and submitted with the LEA grant application expected to be released in late March 2015 with a deadline of April 2015.  This Resolution will enable HHSA to submit LEA Grant applications, execute contract documents, and process subsequent invoices under the signature of the HHSA Director, HHSA Chief Assistant Director, or designee.
 
If the Resolution delegating authority to sign application documents is not approved, HHSA may lose this funding due to the short time line given by the State to submit the application.  This funding pays for the mandated waste site monitoring services provided by County of Placer.

1.  Clerk of the Board to obtain signature of the Chair on two (2) original Resolutions.
2.  Clerk of the Board to return one (1) signed original Resolution to HHSA at 3057 Briw Road.
