DEPARTMENT RECOMMENDATION:
Community Development Agency, Transportation Division (Transportation) , recommending the Board  approve and authorize the Chair to sign Contract Change Order 7.2 with Western Engineering in the amount of $18,000.00 to perform work related to removal and disposal of unsuitable subgrade material on the Pleasant Valley Road (SR 49)/Patterson Drive Intersection Signalization project, CIP No. 73320, Purchasing Contract No. 113-C1499.
 
DISCUSSION / BACKGROUND:
General
On November 5, 2013, the Board awarded the construction contract for the Pleasant Valley Road (SR 49)/Patterson Drive Intersection Signalization project (Project) to Western Engineering, Inc.  The original contract amount was $1,747,742.02.  The Project's roadway improvements were fully opened to motorists in fall 2014.  Final work on the Project was completed in early 2015.
 
Contract Change Order 7.2
Part of the Project is in a low-lying drainage swale.  Accordingly, Transportation budgeted supplemental funds for the removal of material determined to be unsuitable to support the roadway.  Transportation uses supplemental funds for this work because this type of work cannot be quantified during design, and it cannot be accurately bid by the contractor.  During construction, Transportation executed Contract Change Orders (CCOs) 7 and 7.1 for a cumulative value of $99,000.00 to remove unsuitable material from beneath the roadway widening.  These CCOs were written in an attempt to fund removal of unsuitable material as it was encountered.  However, after the work was completed, Transportation met with Western Engineering, Inc. (Western) and it was agreed that Western performed work with total value of $117,000.00 under CCOs 7 and 7.1.  It is important to note that all of this work was performed by Western in accordance with County direction in the field.  The departmental authority for individual change orders pursuant to Board Resolution 102-2012 is $99,887.10 for this Project.  Therefore, Transportation recommends that the Board authorize CCO 7.2 to add an additional $18,000.00 in funding to compensate Western for the work required by CCOs 7 and 7.1.
 
ALTERNATIVES:
The Board may choose not to authorize CCO 7.2.  This would cause Western to file claims against the County for the work that was performed and for which payment was not made.  Therefore, Transportation recommends the Board approve CCO 7.2

CAO RECOMMENDATION:
CAO recommending approval and authorization for the Board Chair to sign Contract Change Order 7.2 with Western Engineering for the referenced project.
 
FINANCIAL IMPACT:
There is adequate balance remaining in the direct construction portion of the adopted Project budget to fully fund CCO 7.2.  Per the Project's cooperative agreement with Caltrans, CCO 7.2 will be funded by a combination of State Highway Operations and Protection Program, State-Local Partnership Program, and Local funds (Developer In-Lieu Fees, El Dorado/Diamond Springs Road Impact Fund, Road Fund, and/or Traffic Impact Mitigation Fees (West Slope)).
 
CLERK OF THE BOARD FOLLOW UP ACTIONS
Obtain the Board Chair's signature on CCO 7.2.  Return CCO 7.2 to Transportation for further processing.
