DEPARTMENT RECOMMENDATION

Staff received and reviewed the signed USDA Forest Service Letter of Consent to the Easement Deed, executed Highway Easement Deed (HED) and supporting documents from US Department of Transportation - Federal Highway Administration. To finalize the easement acquisition, staff needs to record the executed HED.

 

The Community Development Agency, Transportation Division (Transportation) recommends the Board Chair sign the Certificate of Acceptance for the easement acquisition along Ice House Road (County Road 147) as described and depicted within the executed HED. This easement will formally provide access rights to the County and permit the County to perform maintenance, as necessary, across the subject County Road.

 

DISCUSSION / BACKGROUND

Transportation is working in coordination with, and providing oversight for the Federal Highway Administration regarding Ice House Road Surface Rehabilitation Project, CIP No. 72187 along portions of Ice House Road (County Road 147). The project includes Ice House Road between Wentworth Springs Road to Loon Lake, approximately 7.1 Miles.

 

In August 2014,Transportation completed the Right of Way Certification necessary for the commencement of the Ice House Road FLAP Project, CIP No. 72187. Staff continued review and verification of the HED with County Counsel resulting in Counsel’s Letter of Sufficiency in December 2014. In August 2105, staff received the executed USDA Forest Service Letter of Consent and executed Highway Easement Deed. The Deed must be recorded to finalize the Easement acquisition along Ice House Road (County Road 147).

FINANCIAL IMPACT

While there is no cost associated with the acquisition of the easement, funding for the recording fees and staff oversight is budgeted in the adopted 2015 Capital Improvement Program and will be provided by a combination of Federal Lands Access Program (87%) and SMUD Upper American River Project Coop Agreement (13%). This acquisition is not funded by the General Fund and therefore has no Net County Cost.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) The Clerk of the Board will obtain the Board Chair’s signature on the Certificate of Acceptance for the US Department of Transportation Highway Easement Deed.

2) The Clerk of the Board will return the signed Certificate of Acceptance and the supporting documents to Transportation for final processing.
