Title: Community Development Agency, Transportation Division, recommending the Board consider the following pertaining to the El Dorado Trail - Los Trampas to Halcon Project, CIP 97012: 1) Approve and authorize the Chair to sign the Easement Acquisition Agreement for Public Purposes and the Certificate of Acceptance for the related documents from Martin A. Title

Community Development Agency, Transportation Division, recommending the Board consider the following pertaining to the El Dorado Trail - Los Trampas to Halcon Project, CIP 97012:

1) Approve and authorize the Chair to sign the Easement Acquisition Agreement for Public Purposes and the Certificate of Acceptance for the related documents from Martin A. Harmon for Assessor’s Parcel Number 048-471-07;

2) Authorize the Community Development Agency Director, or designee, to execute the escrow instructions and any other related escrow documents pertaining to the transaction, including payment of title and escrow fees; and

FUNDING:  Funding for this project is provided by the following: Accumulative Capital Outlay - Parks (9%), Congestion Mitigation and Air Quality Program (39%), Pollock Pines/Camino Park Zone of Benefit (3%), State Parks Recreational Trails Program (44%), Trails Now Grant (<1%), and the Transportation Development Act (5%).  (Federal Funds)

DEPARTMENT RECOMMENDATION

The Community Development Agency, Transportation Division (Transportation) recommends that the Board Chair sign the Easement Acquisition Agreement for Public Purposes for the El Dorado Trail - Los Trampas to Halcon Project, CIP No. 97012 (Project). The temporary construction easement acquisition is necessary for construction of the Project.

 

DISCUSSION/BACKGROUND

This Project will construct a one mile extension of the El Dorado Trail from its current terminus at Los Trampas Drive (a private road) to Halcon Road.  This multi-use (bicycle, pedestrian and equestrian) trail would be constructed along the old Michigan-California Lumber Company Railroad alignment. El Dorado County owns fee title on this railroad corridor.  Improvements will include a paved bicycle trail, minor widening and drainage improvements.

 

The California Environmental Quality Act (CEQA) Mitigated Negative Declaration was approved by the Board on September 17, 2002.  The National Environmental Policy Act (NEPA) document was adopted by the Federal Highway Administration on June 27, 2013.

FINANCIAL IMPACT

The cost of the easement is $1,100.  The cost for the title and escrow fees are estimated at $2,500.  The total cost is an estimated $3,600.  Funding for the Right of Way acquisition process is budgeted in the 2015 Capital Improvement Program and will be provided by the following: Accumulative Capital Outlay - Parks, Congestion Mitigation and Air Quality Program, Pollock Pines/Camino Park- Zone of Benefit, State Parks- Recreational Trails Program, Trails Now Grant, and Transportation Development Act. 

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) The Clerk of the Board will obtain the Chair’s signature on the Easement Acquisition Agreement for public purposes and the Certificate of Acceptance for the Grant of Temporary Construction Easement.

2) The Clerk of the Board will return one (1) copy of the fully executed Easement Acquisition Agreement to Transportation for final processing.

3) The Clerk of the Board will return the original signed Certificate of Acceptance to Transportation for final processing.
