County Counsel, at the request of the City of South Lake Tahoe, recommending the Board approve and authorize the Chair to execute the Agreement dissolving the Tahoe Basin Transportation System Joint Powers Agreement.

DEPARTMENT RECOMMENDATION

At the request of the City of South Lake Tahoe, County Counsel recommends the Board review, approve and authorize the Chair to execute, the attached Agreement entitled "Dissolution of Tahoe Basin Transportation System and Joint Powers Agreement."

 

DISCUSSION / BACKGROUND

In 1982, the City of South Lake Tahoe, El Dorado County and Douglas County, Nevada created the Tahoe Basin Transportation Joint Powers Authority ("TBT JPA"). Initially, the TBT JPA was created for the purpose of coordinating the cost-effective public transportation system in the south Tahoe region. Since that time, the duties of the TBT JPA have been assumed by the Tahoe Transportation District ("TTD"). The TBT JPA was never dissolved and as a result, the City must provide an annual report of this dormant JPA to the State.

 

Earlier this fall, the City of South Lake Tahoe approached County Counsel about dissolving this JPA. After discussing the matter with attorneys for SLT and Douglas County, confirming with CDA that the JPA is not being used for any projects, and verifying with the Auditor that the County is not holding any funds for the JPA, our office agreed that we would take the dissolution of the TBT JPA to the Board of Supervisors. South Lake Tahoe considered the Dissolution Agreement at their regular meeting on November 3, 2015. The council approved the agreement and authorized the mayor to sign the agreement. Douglas County has scheduled to bring this item before its Board of Commissioners at its first meeting in November.

 

County Counsel requests that the Board review and approve the attached Dissolution Agreement and authorize the Chair to execute.

FINANCIAL IMPACT

There will be no financial impact to the County.

Dissolution eliminates the costs for the City of South Lake Tahoe to prepare end of year reports to the State.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

If approved, Chair will execute the Agreement and the Clerk of the Board will send signed Agreement to the City of South Lake Tahoe.
