DEPARTMENT RECOMMENDATION

Human Resources recommending the Board approve and authorize the Purchasing Agent to sign Amendment II to Agreement No. 498-S1511 with Meyers, Nave, Riback, Silver & Wilson to provide professional legal services on an "as requested" basis for the purpose of providing legal advice to the Civil Service Commission for the Human Resources Department, extending the term of the Agreement by two years through April 30, 2018, and increasing the total not to exceed amount by $200,000 for a new total not to exceed amount of $300,000 based on the department’s estimated cost of services for the contract period.

 

The Board is also being asked to make findings that it is more feasible and economical to engage an outside Attorney for the provision of providing professional legal services on an "as requested" basis for the purpose of providing legal advice to the Civil Service Commission, in accordance with Ordinance 3.13.040.

 

DISCUSSION / BACKGROUND

Historically, the Board has engaged outside counsel to assist the Civil Service Commission in order to ensure impartiality.  The law firm of Meyers, Nave, Riback, Silver & Wilson has a long standing history representing the County in issues brought before the Civil Service Commission.  Human Resources would like to extend the current agreement for an additional two years for continued services with this firm.

 

Per Board Policy C-17, Section 7.11 - Contracts over $100,000, the scope of services and the Consultant's professional qualifications have been reviewed by a representative from outside the Human Resources Department.

CAO RECOMMENDATION

Approve department recommendation.

 

FINANCIAL IMPACT

No change in Net County Cost.  Funding is available in the Human Resources FY 2015-16 budget for current year costs.  Funding for future fiscal years will be included in the department’s annual budget request.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

Following Board approval, the Procurement and Contracts division will process Amendment II with Meyers, Nave, Riback, Silver & Wilson, and submit to the Purchasing Agent for execution.
