FUNDING: Solid Waste Franchise Fees

Background: El Dorado County is mandated by the State to have an LEA to oversee the enforcement of solid waste laws. While the LEA is normally placed in county environmental health departments, El Dorado County, due to Environmental Management being the operator of Union Mine Landfill, faces a potential conflict of interest. State law requires the County to staff the LEA with a full time environmental health specialist. This requirement can be met by contracting with a neighboring jurisdiction with full time staff who have expertise in solid waste management. The LEA receives funding from two revenue streams, a grant from the California Integrated Waste Board (CIWB) and solid waste franchise fees collected by Environmental Management.

Since July 1996, the El Dorado County LEA field services have been contracted to Placer County, a certified Local Enforcement Agency that employs full-time staff with expertise in solid waste management. This arrangement has been both economical and successful in meeting the goals of the program.

Reason for Recommendation: Due to unexpected costs associated with this service, an additional $1,622 is needed to partially reimburse Placer County for services performed in FY 05/06. Placer County has agreed to accept this partial reimbursement to cover expenses in FY 05/06, alleviating the additional burden placed on El Dorado County.

Fiscal Impact/Change to Net County Cost: An increase of $1,622 will raise the total annual compensation of this agreement to $86,622 in FY 05/06. This increased cost has been covered by Environmental Management's...
