Fiscal Impact/Change to Net County Cost: There is no fiscal impact or net County cost.
 
Background: Public Health administers several agreements (mentioned above) that allow for the length or term of each to be extended (referred to here as "options"), without amendment, by mutual consent in writing by both parties.  Those options were included in the contract language because of the routine nature of the services provided and the importance those services held for the County.  
 
The Department assumed that such signature authority rested with the Contract Administrator (identified as the Department Head) and executed extension letters to continue the contracts with the Community Health Center (extended on July 1, 2006) and CaliforniaKids (extended on September 21, 2006).  The original agreement with Alpine County expires on December 31, 2006 and allows for a one year extension. The Purchasing Agent has brought to the Department's attention that the contracts do not explicitly state who is authorized to execute the extension letters. Without specific reference to anyone the authority continues to rest solely with the Board of Supervisors. The Department now fully understands that it did not have authority to extend these agreements and is requesting the Board retroactively approve the two extensions with CaliforniaKids and Community Health Center. Additionally, it is requesting approval to extend the term of the contract with Alpine County for another year.   
 
The following outlines the services and renewal terms of each agreement:
 
CaliforniaKids Healthcare Foundation agreement provides health insurance for uninsured children in El Dorado County; original term for one-year (expired September 20, 2006)with two possible one-year extensions.
 
El Dorado County Community Health Center agreement provides funding from the State Pediatric Immunization Action Plan through El Dorado County to the Community Health Center for children and toddler immunizations; original term for one-year (expired June 30, 2006) with two possible one-year extensions.
 
Ambulance service agreement with Alpine County provides ambulance services to Alpine County for an original term of three-years (expires December 31, 2006) with one possible one-year extension.
 
Reason for Recommendation: Letters extending the aforementioned agreements have already been executed or are in the process of being executed per their respective terms.  Therefore, the Department is recommending the Board retroactively confirm the Contract Administrator's (Director's) authority to exercise the extension options contained in the three aforementioned agreements.
 
Action to be taken following Board approval: Director to continue to extend the term of the aforementioned agreements when the option is available, if appropriate.
