Fiscal Impact/Change to Net County Cost:

 

There is no Fiscal Impact associated with this agenda item.  There is no cost to the County General Fund.

 

Background:

In March 2004, the Department entered into an Agreement with ENTRIX, Inc. (ENTRIX) and in July 2004, the Department entered into an Agreement with Stantec Consulting Inc. (Stantec) to perform various engineering tasks to assist Tahoe Engineering Division staff in delivering Environmental Improvement Program (EIP) projects and to assist with programmatic needs when requested. 

 

In April 2005, Amendment I to AGMT # 03-503 was entered into between the Department and ENTRIX extending the expiration date to December 31, 2007; increasing compensation by $2,000,000.00 for a not-to-exceed amount of $2,500,000; amending Article XV, Notice to Parties; and, amending Article XXV, Contract Administrator.

 

In May 2005, Amendment I to AGMT # 04-607 was entered into between the Department and Stantec extending the expiration date to December 31, 2007; increasing compensation by $3,232,000.00 for a not-to-exceed amount of $3,982,000; amending Article XV, Notice to Parties; and, amending Article XXV, Contract Administrator.

 

Reason for Recommendation:

The purpose of these Amendments is to add various Federal and State provisions, which are required by the granting agencies that fund the work performed under these Agreements.  In addition, the Department is amending Article I, Scope of Services, to revise the Task Order requirements; Article XV, Notice to Parties, to change one of the County's notices recipients; Article XXV, Contract Administrator, to change the County's Contract Administrator; Article XVII, Indemnity, to include the California Tahoe Conservancy (CTC) as an indemnified party; and, Article XVIII, Insurance, to increase the Automobile Liability and include the CTC as additional insured.  There is no change to the compensation or term of these two Agreements.

 

Tasks to be performed under these Amendments include, but are not limited to, engineering design, project management, project delivery, mapping, hydrology and hydraulic calculations, developing and overseeing monitoring plans for design criteria and/or Best Management Practices (BMP) effectiveness, and slope/soil stabilization and revegetation analyses.

 

In addition to the tasks listed above, under these Amendments, the Department may utilize some or all of the following types of classifications, which are not contained in current County job classifications: chemical fate and transport modeler, geologist, hydrogeologist, environmental chemist, toxicologist, fishery expert, biologist, botanist, ecologist, environmental economist, resource economist, wetland scientist, and environmental engineers specializing in hydrodynamics, geomorphology, water management and engineering management of watersheds.

 

The El Dorado County Employees Association, Local #1, has been informed of these proposed Amendments.

 

Action to be taken following Board approval:

 

1)  The Board Chairman will sign the two originals of Amendment II to AGMT # 03-503 with ENTRIX and the two originals of Amendment II to AGMT # 04-607 with Stantec.

 

2)  Upon receipt, the Department will forward the fully-executed Amendments to ENTRIX and Stantec and retain a copy for its files.
