Fiscal Impact/Change to Net County Cost:

There is an annual cost of $7,500 to maintain the 1.5 mile long Sawmill 1A Bike Path Project (Bike Path).  El Dorado County (County) receives Measure S funding in the amount of $5,000 per mile per year for the maintenance of constructed bike paths within the County.  The $7,500 annual maintenance cost will be from Measure S funding in the same amount.  The maintenance responsibilities under this Agreement will take effect upon completion of the Bike Path.  There is no cost to the County General Fund since all maintenance costs will be paid for with Measure S funds. 

 

The Measure S funds are administered by a Community Facilities District Joint Powers Authority that consists of the County, the City of South Lake Tahoe, and the Tahoe Paradise Association.  Voters approved Measure S on September 19, 2000 by 69% and $6.5 million in Bond funds are now available to be utilized to maintain new bike trails, acquire, construct, and equip athletic fields, upgrade the Paradise Park facilities, and construct an ice rink.  Upon completion of the Bike Path, this bicycle facility will also be eligible for Measure S funding. 

 

Reason for Recommendation:

Once construction is complete, a portion of the Bike Path will be located in the Caltrans' right-of-way.  Prior to initiating construction of the Bike Path, Caltrans required the County to obtain a Caltrans Encroachment Permit which states that the applicant "agrees, by acceptance of the permit, to properly maintain any encroachment" on the State right-of-way.  The subject Maintenance Agreement details the County and Caltrans' maintenance responsibilities for the Bike Path, upon completion of the trail segment.  This Agreement is a standard-form Caltrans' Maintenance Agreement.  The maintenance responsibilities outlined in the Agreement are consistent with past bicycle trail projects that have been constructed by the County in Caltrans' right-of-way, such as the Pat Lowe Memorial Trail. 

 

Under the subject Maintenance Agreement the County will be responsible for operating, maintaining and repairing the improvements within Caltrans' right-of-way upon completion of the Bike Path.  The Department of Transportation's Maintenance Division in South Lake Tahoe has all the necessary equipment and resources for operating, maintaining and repairing the Bike Path and all existing and newly installed fences, guardrailing, removable bollards, lighting structures, drainage facilities, slopes and structural supports necessary for the existence and operation of the Bike Path.  This will ensure a safe facility along the entire length of the Bike Path and will ensure the operation and maintenance of all vegetative plantings and landscaping associated with normal erosion control throughout its useful life.

 

Action to be taken following Board approval:

1. The Board Chairman will sign the three (3) originals of the subject Agreement.

2. The Board Clerk will forward the three (3) originals of the subject Agreement to County Counsel for their signature.

3. Upon signing, County Counsel will forward the originals back to the Board Clerk.

4. The Board Clerk will send the originals of the Agreement to the Transportation Department for further processing to Caltrans.

5. Upon receipt of the fully-executed Agreement from Caltrans, the Transportation Department will forward the original Agreement to the Board Clerk's office and retain a copy for its files.
