Development Services Department, Planning Services Division, recommending Chairman be authorized to sign Certificate of Acceptance for a Deed of Conservation Easement from the Cameron Park Community Service District as required pursuant to Mitigation Measure 1 imposed on Special use Permit S05-0032.

Background: The subject Deed of Conservation Easement would grant a minimum of 0.94 acre of oak tree canopy on property under ownership of the Cameron Park Community Service District to the County.  The easement was required as Mitigation Measure 1 under Special Use permit S05-0032 approved by the Planning Commission on September 14, 2006, for the development of the Cameron Park Community Center, and reads as follows:
 
"Prior to grading permit issuance, the Cameron Park Community Service District (CSD) shall dedicate and record a conservation easement on property under their ownership that contains oak tree canopy of the amount equal to twice that existing on the project parcel, for a total of 0.94 acres of oak tree canopy. The conservation easement will be offered to the County, but the land shall be maintained by the CSD.  A 4/5 vote of the Board of Supervisors will be necessary to remove the easement."
 
The subject Deed has been reviewed and approved by County Counsel.
 
Action to be taken following Board approval: The Board Clerk's Office will record the Certificate of Acceptance.
