This is a three year contract with payment terms as follows:
For the period of February 1, 2007 through June 30, 2007 annual payment will be $ 32,904.17;
(The funding for the above term of the agreement is budgeted in the current year I.T. budget)
For the period of July 1, 2007 through June 30, 2008 annual payment will be $ 83,554.17;
For the period of July 1, 2008 through June 30, 2009 annual payment will be $89,972.00;
For the period of July 1, 2009 through January 31, 2010 annual payment will be $ 52,483.67.
 
The total of this agreement will not exceed $ 258,914.01 plus applicable sales tax.

Necessary funding is in the Information Technologies budget for the period through June 30, 2007.  The balance of the total estimated cost will be budgeted in future years.
 
Background:
 
IBM has been providing software maintenance to the County for a number of licensed products since 1999, under Agreement #377-S9911 "IBM Customer Agreement" and "Supplement for License of Programs".  In January, 2007, the County procured a new IBM z9 Business Class server (mainframe) to replace the existing IBM Multiprise 3000 Enterprise Server.  The winning bidder in the procurement was Jeskell, Inc., a Premier IBM Business Partner, authorized by IBM under our IBM Customer Agreement to represent IBM.  Details of the Jeskell bid included special software maintenance pricing for specific software products, for a three (3) year period of time, under IBM's Enterprise Growth Offering (EGO).  This offering will provide substantial saving to the County; however, payment for the software maintenance will be to Jeskell rather than IBM.  This, too, is provided for under our IBM Customer Agreement, which also stipulates that IBM is responsible for providing the  services. Accordingly actual software maintenance will continue to be provided by IBM.
 
Reason for Recommendation:
 
The licensed IBM software is necessary to operate the mainframe which provides the hardware/software platform on which mission critical County applications are processed, including FAMIS/BPREP, ADPICS, HR/Payroll, Property and the Land Management System.  Software maintenance is necessary to maintain the licensed products in a current and trouble free state.  It also provides for periodic updates and enhancements to the software from IBM.
 
Action to be taken following Board approval:
 
1.  Authorize the Board Chairman to sign two copies of the Agreement for Services #568-S0711.
2.  Board Clerk shall forward one original copy to Information Technologies.
3.  Procurement and Contracts shall create a blanket purchase order to facilitate payment for the IBM software maintenance.
4.  Information Technologies shall forward the original copy of the agreement to Jeskell, Inc.
5.  Information Technologies shall process IBM software maintence invoices for payment.
