RECOMMENDED ACTION:  The Planning Commission recommends the Board take the following action:  1.  Adopt the negative declaration, as prepared; and 2.  Approve Z06-0024 rezoning property identified by Assessor's Parcel Number 097-020-42 from Commercial-Design Review District (C-DC) to Limited Multifamily Residential-Community Design Review District (R2-DC), based on the findings listed on Attachment 1.
 
 
 
Background: This item was first considered by the Planning Commission on January 25 and unanimously recommended for approval.  Due to an advertising error, the project was again considered by the Commission on February 22, 2007, and again unanimously recommended for approval.  One adjacent property owner spoke about flooding of properties in this area that the residents believe is caused by development on the subject property. The applicant stated any development on this property would have to pipe any drainage down to Pleasant Valley Road.  See minutes (Attachment 2) for further discussion. There were no new significant issues discussed other than those in the staff report.
